$100,000 – $220,000 base salary, plus quarterly bonus eligibility

Position Overview

The Workers’ Compensation Defense Attorney will be responsible for managing a caseload of workers’ compensation matters from inception through resolution. This role requires direct representation of clients before the California Workers’ Compensation Appeals Board (WCAB), including appearances at hearings, conferences, and trials, as well as handling depositions, motion practice, and settlement negotiations.

The position requires a high level of autonomy, sound legal judgment, and the ability to manage competing priorities in a fast-paced legal environment.

Key Responsibilities

  • Represent employers, insurance carriers, and third-party administrators in all aspects of workers’ compensation defense proceedings
  • Appear before the WCAB for status conferences, mandatory settlement conferences (MSCs), lien conferences, and trials
  • Independently manage a full caseload from initial assignment through final resolution
  • Take and defend depositions, including depositions of treating physicians and medical evaluators
  • Draft, review, and file legal documents, including pleadings, petitions, motions, declarations, and settlement agreements
  • Conduct legal research and apply California workers’ compensation statutes, regulations, and applicable case law
  • Negotiate settlements, including Compromise and Release agreements and Stipulations with Request for Award
  • Provide strategic legal counsel and case analysis to clients and claims professionals
  • Maintain timely and professional communication with clients, adjusters, and internal stakeholders
  • Accurately track and manage billable time in accordance with firm expectations

Minimum Qualifications (Must-Haves)

  • Active and in good standing with the California State Bar
  • Minimum of 1.5 to 2+ years of experience practicing California workers’ compensation defense law
  • Demonstrated experience representing employers, insurance carriers, or third-party administrators
  • Working knowledge of WCAB procedures, rules, and litigation processes
  • Proven ability to independently manage a high-volume caseload
  • Strong legal writing, analytical, and oral advocacy skills
  • Proficiency in a paperless, technology-driven legal environment, including case management systems and digital documentation
  • Ability to meet deadlines and maintain high standards of professional responsibility and client service

Preferred Qualifications (Nice-to-Haves)

  • Experience taking and defending medical (doctor) depositions
  • Trial experience before the WCAB, including first or second chair participation
  • Prior experience in a workers’ compensation defense law firm or as in-house counsel for a carrier
  • Familiarity with billing practices and maintaining consistent billable hours
  • Experience utilizing dictation software and advanced case management platforms
  • Demonstrated interest in leadership, mentorship, or long-term career advancement within a law firm setting
  • Strong client relationship management skills

Compensation and Benefits

  • Base salary range of $100,000 to $220,000, commensurate with experience and qualifications
  • Eligibility for a quarterly bonus program, with potential annual earnings up to $52,000 based on productivity and performance metrics

Non-Negotiable Requirements

  • Candidates must possess current and relevant California workers’ compensation defense experience; experience in other practice areas (including but not limited to personal injury, employment law, medical malpractice, or general liability) will not be considered a substitute
  • Candidates must be available to work full-time without restriction or modified schedules
  • Candidates must demonstrate the ability to operate effectively within a fully remote, paperless legal environment
  • Candidates must be authorized to work in the United States without restriction
