Job Description

Scale LLP is seeking an Intellectual Property Attorney with ideally 10+ years of significant ITC litigation experience. Our growing patent litigation practice has a need for attorneys with substantive experience to make an immediate contribution on existing cases. Who We're Seeking:

We are seeking a seasoned attorney with experience with International Trade Commission section 337 litigation who is looking to work on cases of significant importance to our clients.

You may be a perfect fit if you:

  • Have played a meaningful role in patent and trademark litigations before the ITC
  • Have in-depth knowledge of ITC procedure and patent law and procedure
  • Have inter partes review experience
  • Have taken or defended numerous depositions of technical expert witnesses 
  • Have excellent research and writing skills
  • Enjoy owning a significant piece of litigation or dispute and leading teams
  • Are team- and growth-oriented, and enjoy working with colleagues who share that approach

How We Work:

Scale attorneys are not salaried; instead, Scale pays attorneys a percentage of the fees collected from their clients. Unlike in a traditional law firm setting, where attorneys typically receive a third of the value they create for the law firm, Scale attorneys net a combination of collected origination and matter responsible fees.

Association as Counsel. We are willing to accept attorneys from senior in-house positions with no demonstrable book as counsel. Because the firm’s collections-based model only works for attorneys capable of developing client work, however, we require applicants to identify at least one anchor client and articulate a clear business development plan at association.

Partnership. To be considered for a lateral partnership, we ask that applicants be prepared to demonstrate a significant transferrable book of originations and be in position to generate outgoing work for another attorney or attorneys at the firm.
