Apex Building Company, LLC is seeking a proactive and solutions oriented Legal Counsel to support our Division 7 construction operations with expert legal guidance, contract management, and risk mitigation. This role serves as a strategic partner across departments, ensuring compliance, protecting company interests, and fostering a culture of integrity and accountability.
The In-House Legal Counsel serves as the primary legal advisor for the company’s Division 7 waterproofing construction operations, providing strategic guidance on contracts, compliance, risk management, and project execution. This role ensures legal integrity across business functions and supports project teams in navigating complex regulatory and contractual landscapes. This position is classified as full-time, with a standard schedule of 40 hours per week. Additional hours may be required based on project deadlines.
Job Responsibilities
Contract & Project Support
Drafting, Reviewing, and negotiating construction contracts (GC, Subcontractor, Vendor)
Ensure project documentation aligns with industry standards and company policies
Advise project managers on legal risks, change orders, and dispute resolution strategies
Ensuring enforceability and risk mitigation in payment terms, scope, indemnity, and termination clauses
Compliance & Risk Management
Navigating federal, state, and local construction regulations (OSHA, building codes, environmental laws)
Manage/Advise on licensing, permitting, and insurance requirements across jurisdictions
Identify and mitigate legal risks in business operations and project execution
Monitor evolving legislation affecting construction practices
Risk Assessment & Liability Management
Identifying potential legal exposures across project lifecycles
Advising on insurance coverage (GL, builder’s risk, professional liability)
Supporting safety and incident response protocols
Employment & Labor Law
Advise on hiring practices, wage compliance, and union relations
Draft employment agreements and managing workplace investigations
Ensure adherence to EEOC, FMLA, and other employment regulations
Business Operations
Support HR, finance, and procurement teams with legal guidance on employment law, billing practices, and vendor agreements
Review internal policies and procedures for legal soundness and operational clarity
Assist in corporate governance, including entity management
Dispute Resolution & Claims
Handle claims related to defects, delays, payment disputes, and workplace incidents
Coordinate with external counsel for litigation, arbitration, or mediation as needed
Maintain documentation and communication protocols for legal proceedings
Coordinating with outside counsel and insurers when needed
Facilitate proactive problem solving across departments
Training & Policy Development
Develop legal training materials for project teams and business units
Create standardized templates and workflows to streamline legal processes
Promote a culture of compliance, fairness, and accountability
Job Requirements
Education and/or Experience
Juris Doctor (JD) from an accredited law school; active bar membership required
3+ years of legal experience, preferably in construction
Strong knowledge of construction law, contract negotiation, and regulatory compliance
Excellent communication and analytical skills; ability to translate legal concepts for non-legal audiences
Proven ability to manage multiple priorities in a fast paced, deadline drive environment
Preferred Attributes
Experience in waterproofing, specialty trades, or niche construction sectors
Familiarity with OSHA, lien laws, and insurance/bonding requirements

Technical Proficiency
Proficient in Microsoft Office Suite (Word, Excel, Outlook, PowerPoint)

Experience with project management software
