The Legal Services section of the North Carolina Department of Commerce, Division of Employment Security (“DES”), consists of a lead Division Counsel, a Deputy Division Counsel, six (6) staff attorneys, and eight (8) paralegals/legal assistants. The section provides legal services to all sections and employees of DES located anywhere within the State of North Carolina, and other services as directed by the General Counsel, the Assistant Secretary of Commerce – DES, or the Secretary of Commerce. The position reports to the General Counsel for the Department of Commerce, who reports to the Secretary of Commerce.
Subject to appropriate legal restrictions, the Division Counsel, each of their subordinate attorneys, and their respective paralegals/legal assistants are required to provide information about and/or explanations of laws, regulations, policies, procedures, rules and actions of DES — regardless of the program to which to they relate — to the general public; federal, state, and local elected and appointed governmental officials; employees and other representatives of other federal, state and local governmental agencies; private and public sector employers; labor unions; judicial and other court personnel; parties to quasi-judicial and administrative proceedings before DES and other administrative agencies; etc. In addition, the Division Counsel is responsible for issuing advisory opinions and interpretations regarding laws, regulations, policies and rules, as requested by the public, General Counsel, Secretary of Commerce, Assistant Secretary of Commerce – DES, program managers, and other DES personnel.
Duties for this position include:
- Responsible for overseeing, supervising, managing and directing the activities of a team consisting of a Deputy Division Counsel, six (6) staff attorneys and eight (8) paralegals/legal assistants who are responsible for all legal matters and issues affecting DES.
- Represent DES in internal administrative appeals hearings and other proceedings.
- Provide legal support to DES’s Board of Review.
- Represent DES, its personnel, and other stakeholders in litigation in federal and state courts and administrative agencies.
- Advise DES senior management and other stakeholders on various legal and operational issues relating to and arising out of DES’s activities and responsibilities.
- Provide legal representation, advice, counsel and guidance to DES as to all matters of a legal, quasi-legal, legislative and various internal and external policy matters relevant to DES.
- Provide representation, advice, counsel and guidance related to the various programs administered according to federal and state laws, and all other matters arising under applicable federal, state and local laws, regulations, policies and rules, including but not limited to federal and state constitutional issues, bankruptcy, contracts, employment, finance, labor relations, personal and real property, tax, workers compensation, procurement, etc.
- Respond timely and accurately to inquiries from the public, various state and federal agencies, and public records requests in accordance with the Department’s policy. This includes reviewing and drafting appropriate agreements for requests for sensitive or confidential information subject to protection under state and/or federal law.

Knowledge, Skills and Abilities / Competencies

- Comprehensive knowledge of the laws and principles governing employment security, unemployment insurance, confidentiality and data security, procurement, and labor/personnel law, including the State Human Resources Act, Americans with Disabilities Act, Fair Labor Standards Act, Family Medical Leave Act, and Title VII of the Civil Rights Act of 1964.
- Demonstrated skills and abilities needed to litigate complex federal and state cases involving issues relating to discrimination, harassment and retaliation.
- Demonstrated ability to handle complex issues of confidentiality, data security and data security breaches.
- Demonstrated experience perform strategic case management through analysis, research, planning, developing and executing an effective litigation strategy to achieve desired result(s) in novel or complex cases.
- Demonstrated experience preparing persuasive appellate briefs and other appellate documents in cases involving novel or complex facts or legal issues; and ability to conduct appellate oral arguments in cases involving complex facts or novel legal issues, including the ability to listen, analyze and respond to questions from the appellate courts.
- Previous experience overseeing, supervising, managing and directing the activities of subordinates, as well as coaching them and assisting them in developing their professional talents.
