THE STARTING SALARY FOR THIS POSITION IS LIMITED TO $116,147 to $ 138,083. The position is client funded. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

This position serves as Section Head for the Public Health and Child Welfare Section within the Health and Human Services Division of the N.C. Department of Justice. The primary purpose of the position is to supervise the work of four Attorneys, and one Administrative Specialist who work on Public Health and Food Program matters, and four Attorneys, one Paralegal and one Administrative Specialist who work on Child Welfare and Child Support matters. Because of the expanding nature and varying missions and goals of these programs, the individual in this position must possess a wide array of subject matter expertise areas of public health, child welfare, child support enforcement and food programs. The individual in this position will also work with two Attorneys in the Special Litigation Section who represent the Department of Health and Human Services. Since attorneys in the Public Health and Child Welfare Section and the Special Litigation Section work on many complex cases, the individual in this position must be thoroughly familiar with complex litigation processes and procedures in State and federal court.

This position oversees all litigation handled by the Section and all legal advice and counsel provided to the Section’s clients on non-litigation matters and keeps the Division Head informed of all significant developments. In coordinating the work of the Section, this position makes appropriate assignments based on the expertise and abilities of the staff and needs of the client, determines priorities and legal representation needs, monitors progress and makes adjustments as needed.

The individual in this position must exercise substantial discretion and make quick, independent decisions. Additionally, the individual in this position must be able to work effectively with others including high-level State officials in a complex, constantly changing environment.

This position requires strong management and supervisory skills. Management and supervisory duties include long and short-range planning for the Section; organizing and directing work of the Section; financial management; review of work and feedback; and recruiting, training and managing personnel, including conducting performance reviews, making recommendations and providing written justification for promotions and salary increases, and taking disciplinary action when necessary.

This position also advises client agencies, boards and commissions. Duties include recognizing and analyzing legal problems affecting current and proposed agency operations and proposing solutions; participating in settlement negotiations where appropriate; preparing or reviewing contracts and MOUs; reviewing and revising current and proposed administrative rules; representing rulemaking commissions before the NC Rules Review Commission; drafting proposed legislation; advising on the impact of court decisions and new or proposed administrative rules and statutes on agency operations; responding to citizen inquiries, subpoenas and public records requests; and drafting advisory letters.

This position represents the State in criminal appeals and performs such other duties as may be assigned by the Division Head, Bureau Chief, Attorney General or his/her designee.

Qualifications

Knowledge, Skills and Abilities / Competencies

The Section Head must have the ability to learn and develop a working understanding of the several regulatory laws enforced by DHHS and have the ability to become an expert in the requirements and provisions of each of these laws.

Additionally, this position must have the:

· Ability to promptly make management and legal strategy decisions and promptly execute on those decisions.

· Thorough knowledge of case, statutory, regulatory, and common law.

· Ability to interpret and apply dense State statutory schemes with an overlay of Federal statutes, interpret and apply laws, constitutional provisions, statutes, administrative regulations, and court decisions.

· Ability to conduct complex civil litigation in specialized areas of law from the trial stage through the appellate stage.

· Ability to express conclusions and arguments clearly, concisely, and logically in oral and written form.

· Proven ability to use good judgment and discretion in performing one's job responsibilities and effectively collaborate with others throughout and outside of NC DOJ.

Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and five years of progressively responsible professional legal experience.

NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

Management preferences include:

· Demonstrated strong interpersonal skills.

· Ability to independently develop creative solutions to legal issues and management challenges.

· Demonstrated ability to effectively collaborate with management, colleagues, team members, and clients.

· Ability to lead a team of specialized professionals effectively.

· Experience/knowledge in public health and child welfare issues, and/or demonstrated ability to master technical areas of law.

· Experience independently litigating civil cases in a variety of forums, including administrative tribunals and State and Federal courts.

· Ability to multi-task and prioritize effectively, and lead others in the Section to the do the same.
