Job Description

The position will be on site at our corporate office in Grand Island, Nebraska.

In-House Counsel will help oversee all legal matters for Credit Management Services, a Grand Island, Nebraska based account recovery agency, ensuring compliance with all federal, state and local laws. This individual will work closely with other in-house attorneys to provide legal guidance to the management team and to manage litigation matters. The role requires a proactive approach to mitigating risk, ensuring ethical practices and maintaining the agency's reputation

Key Responsibilities:

  • Monitor and ensure compliance with applicable laws and regulations, including the Fair Debt Collection Practices Act (FDCPA), Health Insurance Portability & Accountability Act (HIPAA), Gramm-Leach-Bliley Act (GLBA) and state collection laws.
  • Represents the agency in legal proceedings, in regulatory matters and in resolving legal issues.
  • Further legal collection files by reviewing, editing and filing legal pleadings, monitoring both pre-judgment and post-judgment collection efforts, negotiating settlements, attending hearings and trials.
  • Advise the management team on legal risks, business strategies and policy decisions.

Qualifications:

  • Juris Doctor degree from an accredited law school and licensed to practice law in Nebraska. Additional state licenses in Kansas, Wyoming, Iowa and South Dakota are beneficial.
  • Compliance, debt collection and/or litigation background is preferred.
  • Strong communication skills, problem-solving skills and high level of professionalism is required.
  • Ability to travel for hearings, trials, conference and training, as needed.
