The Plaintiff Collection Attorney is a legal professional who specializes in representing creditors, financial institutions, or businesses in the process of collecting outstanding debts from individuals or entities that owe money. Their primary focus is on initiating legal actions against debtors to recover the owed funds on behalf of clients.
Responsibilities:
- Conducting legal research to understand the rights and obligations of both creditors and debtors. This involves staying informed about relevant laws and regulations related to debt collection.
- Advising and consulting with clients on the best course of action for debt collection. This may involve assessing the legal standing of the debt, the likelihood of success in court, and potential alternatives.
- Creating legal documents such as demand letters, complaints, and court filings to initiate legal proceedings against debtors. These documents outline the legal basis for the debt collection action.
- Representing clients in court during debt collection proceedings. This includes presenting the case, arguing legal points, and advocating for the client’s interests.
- Engaging in negotiation with debtors, either directly or through alternative dispute resolution methods, to reach a settlement or repayment agreement.
- If the court rules in favor of the creditor, the Plaintiff Collection Attorney may be involved in the enforcement of judgments, such as garnishing wages or placing liens on property.
- Ensuring that all debt collection practices adhere to relevant laws, regulations, and ethical standards. This includes compliance with the Fair Debt Collection Practices Act (FDCPA) and other applicable laws.
- Maintaining accurate and thorough documentation of all communications, actions, and legal proceedings related to the debt collection process.
- Law Degree – Member of the Florida Bar Association
- At least 3yrs of Experience Practicing Law
- At least 2yrs of Experience with Plaintiff Collection Litigation
- Prior Experience in the Construction/Home Improvement Field is a Plus
- Strong understanding of debtor-creditor law, contract law, and relevant legal procedures
- Effective communication and negotiation skills when dealing with both clients and debtors
- Ability to stay informed about changes in laws and regulations related to debt collection
