Job Description

The Investigator 3 plays a vital role in supporting the agency’s mission to protect the public from workers' compensation fraud and ensure employer compliance with workers' compensation insurance requirements. Operating within the Legal Division’s Fraud and Compliance Unit, this position is responsible for conducting complex, statewide investigations involving alleged workers' compensation fraud and uninsured employer compliance referrals.

This position may offer the ability to work remotely, within Arizona, based upon the department's business needs and continual meeting of expected performance measures.

Duties

Essential Duties and Responsibilities include but are not limited to:

● Plan, organize, and conduct complex investigations into alleged workers' compensation fraud and employer non-compliance with statutory insurance requirements.
● Interview witnesses, claimants, employers, and medical providers, preserve testimony, and perform field surveillance.
● Locate, examine, gather, and preserve physical, digital, and documentary evidence utilizing public and governmental resources.
● Evaluate investigative findings and apply relevant statutes, regulations, and agency policies to determine if allegations are substantiated based on a preponderance of the evidence.
● Prepare enforcement recommendations regarding referrals to the Attorney General's Office for criminal prosecution, licensing board actions, civil penalties, or injunctive relief.
● Maintain detailed investigation logs and write comprehensive investigative reports documenting methods, evidence, timelines, activities, findings, and conclusions.
● Testify as an official agency witness in court proceedings, grand jury, or administrative hearings regarding investigative activities and findings.
● Collaborate and communicate with supervisors, legal counsel, and stakeholders to discuss investigative plans, resolve complex issues, and provide status updates.
● Operate a state vehicle and travel throughout Arizona as necessary to execute field operations and official business.
● Attend and participate in Arizona Management System (AMS) huddles, required training, agency, department, and unit meetings.

Qualifications

Knowledge in

● Arizona administrative practices and procedures and personnel rules and requirements.
● Federal, State, and agency laws pertaining to, workers’ compensation, fraud, occupational safety and health, debt collection, labor, investigations, and evidence.
● Purposes, goals, policies, procedures and practices of the Commission and the Legal Division.
● Techniques and methods of interviewing and records searching.
● Private industry practices and government, business, and occupational regulations.
● Investigative technology and equipment.
● Investigative techniques and tools, including Internet tools, databases, and other sources of information relevant to the agency investigations.

Skills in

● Teamwork.
● Planning/organization, multi-tasking, and time management.
● Clear and concise oral and written communication, including attention to detail.
● Use of computers and other technical devices/programs/software, including investigative technology/equipment.

Selective Preference(s)

The ideal candidate for this position will have:

• College Degree
• Three years of experience in an investigation-related profession.
• Fluent in Spanish.
• Course or training in investigative techniques and procedures.
• Possess competent computer skills, with an emphasis on knowledge of various social media applications, such as Facebook, Twitter and Instagram.

Pre-Employment Requirements

If this position requires driving or the use of a vehicle as an essential function of the job, then the following requirements apply. Any employee operating a motor vehicle on State business must possess and retain a current, valid class-appropriate driver’s license, complete all required training, and successfully pass all necessary driver’s license record checks. The license must be current, unexpired, and neither revoked nor suspended. Employees who drive on state business are subject to driver’s license record checks, must maintain acceptable driving records, and must complete all required driver training. An employee who operates a personally owned vehicle on state business shall maintain the statutorily required liability insurance (see Arizona Administrative Code (A.A.C.) R2-10-207.11).

Retirement

You will be eligible to participate in the state employee health/disability insurance plan, and you are required to participate in the Arizona State Retirement System (ASRS). ASRS participation may begin immediately or upon your 27th week of employment. Contributions are matched by the employer.
