Under the general direction of the Assistant Chief Counsel, Legal Affairs Division, the Attorney III serves as the Bureau of Real Estate Appraisers' (BREA) general legal counsel.

The Attorney III reviews investigative files, draft pleadings, orders, legal memoranda, and related documents, and at times, negotiates the settlement of matters and prepares the appropriate documentation. The Attorney III must remain apprised of federal changes to ensure the Bureau’s compliance with federal laws, regulations, policy, and requirements.

The Attorney III responds orally and in writing to external and internal inquiries relating to the Business and Professions Code Section 11300, et seq, and the regulations contained in the California Code of Regulations (CCR) Title 10, Chapter 6.5, Sections 3500, et seq, relevant federal law, the regulations implementing the law and related sections of other code provisions. The responses must be reasoned, clear, understandable, and based on past or present office policy or interpretations of laws and regulations.

• Experience advising a public regulatory entity and developing subject matter expertise in a variety of complex subjects, including licensing and enforcement matters.

• Experience drafting and analyzing rules, regulations and/or proposed legislation.

• Experience responding to Public Records Act requests, subpoenas, or discovery.

• Experience developing policies and procedures for an organization or state agency.

• Experience drafting contracts, including memorandums of understanding and inter-agency agreements.

• Experience in litigation, including preparing briefs and making court appearances.

Department Information

The Department of Consumer Affairs (DCA) protects and serves California consumers while ensuring a competent and fair marketplace. DCA educates consumers and protects professionals from unfair competition by unlicensed practitioners.

DCA is a unique and dynamic department consisting of 36 different boards, bureaus, a commission, and a program that license and regulate more than 3.4 million licensees in more than 280 license types including certificates, registrations, and permits. The Legal Division provides legal services to the Department's Executive staff, bureaus, programs, boards, and a commission. The Legal Division serves as in-house counsel for the Director, and the Department's constituent agencies. Its attorneys regularly attend and provide legal advice at meetings and hearings held by the Department's constituent agencies. It provides legal analysis and opinions on laws, issues, and proposed legislation relevant to the Department and its constituent agencies, including the regulatory licensing laws of the Business and Professions Code, conflict of interest laws, the rulemaking process, and administrative adjudications. It also provides advice on government contracts, employer-employee matters such as equal employment opportunity issues and employee disciplinary matters, the Open Meetings Act, the Public Records Act, and the Information Practices Act. It serves as litigation liaison for the Department with the Office of the Attorney General.

The Bureau of Real Estate Appraisers (BREA) is charged with licensing real estate appraisers in the State of California; it is the Bureau’s mission to safeguard public trust by promoting professionalism in the real estate appraisal industry through licensing, education, and enforcement. BREA has two primary regulatory functions--appraiser Licensing/AMC registration and Enforcement. The Licensing Unit ensures that applicants meet minimum requirements for education, experience, and examination that comply with federal mandates and ensure that only qualified persons are licensed to conduct appraisals in federally related real estate loan transactions. The Enforcement Unit investigates complaints of violations of the Uniform Standards of Professional Appraisal Practice (USPAP) and ensures that licensees adhere to all applicable laws and regulations.

Special Requirements

The position requires a State Bar License. You will be required to provide a copy of your State Bar License prior to being hired and must maintain an active membership with California State Bar.

Conflict of Interest: This position is subject to Title 16, section 3830 of the California Code of Regulations, the Department of Consumer Affairs' Conflict of Interest Regulations. The incumbent is required to submit a Statement of Economic Interests (Form 700) within 30 days of assuming office, annually by April 1, and within 30 days of leaving office.

When in the office, the Attorney III will typically report to BREA's office suite in Rancho Cordova, but may also report to the Legal Division office suite in Natomas. BREA is located right off of US Highway 50 between Zinfandel Dr. and Sunrise Blvd. The building offers free parking and is close to many restaurants and convenient shopping venues.
