The Opportunity

Within Aeroflow, the Legal and Compliance Department’s mission is to safeguard the organization while advancing its vision to improve patient- and family-centered care. We are currently seeking an Associate General Counsel (AGC) to join our growing team.

This position is based at our headquarters in Asheville, North Carolina. Candidates must be local or willing to relocate; relocation assistance may be provided for highly qualified out-of-state candidates.

The AGC will serve as a key legal advisor to Aeroflow’s leadership and operational teams, providing strategic counsel on contracting, healthcare regulatory oversight, HIPAA privacy and security, and enterprise risk management. Reporting to the General Counsel, this role plays a critical part in protecting the company’s legal interests, ensuring compliance, and supporting corporate strategy.

The AGC will serve as a key legal advisor to Aeroflow’s leadership and operational teams, providing strategic counsel on contracting, healthcare regulatory oversight, HIPAA privacy and security, and enterprise risk management. Reporting to the General Counsel, this role plays a critical part in protecting the company’s legal interests, ensuring compliance, and supporting corporate strategy.

Your Primary Responsibilities

  •  Contract Review & Management
    •  Draft, review, negotiate, and manage a wide range of contracts, including vendor agreements, BAAs, purchase/lease agreements, and service contracts.
    •  Develop standardized templates, approval workflows, and lifecycle processes to improve efficiency and mitigate risk.
    •  Advise leadership on rights, obligations, and risks, including indemnities, limitation of liability, warranties, and data protection.

  •  Regulatory & Healthcare Law
    •  Provide counsel on federal and state healthcare laws impacting DME operations—including Medicare/Medicaid rules, Anti-Kickback Statute, Stark Law, False Claims Act, FDA regulations, and licensing requirements.
    •  Track and interpret legislative and regulatory changes, advising on operational and strategic impacts.
    •  Represent Aeroflow in responding to government inquiries, audits, and investigations.

  •  Privacy, Data Protection, and Cybersecurity
    •  Serve as lead legal advisor on HIPAA Privacy and Security Rules, data governance, and technology compliance.
    •  Partner with compliance and IT to oversee PHI handling, BAAs, and breach response protocols as well as the use of tracking technologies on websites and applications..
    •  Support the design of policies, risk assessments, and employee training around data protection.
    •  Employee has an individual responsibility for knowledge of and compliance with laws, regulations, and policies.
    •  Compliance is a condition of employment and is considered an element of job performance
    •  Maintain HIPAA/patient confidentiality
    •  Regular and reliable attendance as assigned by your schedule
    •  Other job duties assigned

  •  Risk Assessment & Mitigation
    •  Identify, assess, and manage legal, regulatory, and reputational risks across business functions.
    •  Develop proactive strategies with leadership to minimize exposure while enabling growth.
    •  Support governance processes and ensure adherence to laws and internal policies.

 

Required Qualifications

  • Juris Doctor (JD) degree from an accredited law school.
  •  Licensed to practice law in North Carolina or other US state with the ability to apply for admission to the North Carolina Bar.
  • Minimum 5-7 years of progressively responsible legal experience in healthcare
  •  Prior experience in DME compliance is a plus.
  •  Proven expertise in healthcare regulatory compliance (Medicare/Medicaid, Anti-Kickback Statute, Stark Law, False Claims Act, FDA/device regulations), complex contract negotiation, and risk management.
  •  Strong knowledge of HIPAA and data privacy laws, including tracking technology, with experience managing BAAs and breach response. 
  • Experience advising a DME or medical device organization
