Job Focus Area
The Department’s attorneys provide legal advice and conduct research for Department staff. They may also represent the Department before administrative and judicial tribunals; make presentations to the Board of Elementary and Secondary Education (BESE), the legislature, and other public forums; provide assistance, information, and training to Local Education Agencies (LEAs), community resource partners, and the public; and perform other duties in support of public elementary and secondary education.The responsibilities of this position include monitoring and ensuring compliance, as well as providing legal advice on issues related to the Individuals with Disabilities Education Act (IDEA), 20 U.S.C. § 1400 et seq., the Louisiana Children with Exceptionalities Act, and their implementing regulations. The role focuses on managing all pertinent legal issues concerning exceptionality-related disputes and ensuring compliance with federal and state laws and regulations.
This position also manages, monitors, and evaluates statewide compliance with federally and state-mandated procedures, statutes, and regulations; advises Department staff on legal matters; and recommends, reviews, and drafts legislation and regulations.

Possession of a current Louisiana license to practice law plus three years of experience as a practicing attorney.

Job Duties:
The responsibilities and duties of this position are:
- Monitoring and ensuring compliance as well as provide legal advice and conduct legal research and investigations related to the Individuals with Disabilities Education Act (20 USC 1400 et. Seq., the Louisiana Children with Exceptionalities Act and their implementing regulations.
- Work with parents and local education agencies and their legal representatives to resolve exceptionality related disputes.
- Conduct formal state complaint investigations and issue written decisions related to exceptionality related complaints.
- Provide the Department of Education with legal analysis and advice concerning special education program management and federal reporting.
- Represent the Department in judicial proceedings at trial and appellate levels.
- Assist in preparation and review of Department contracts, request for Proposals, Memorandum of Understanding, Interagency agreements and other legal documents affecting individuals with disabilities.
- Work with other staff in matters as assigned by the supervisory attorney and executive counsel.
- Review of proposed state and federal legislation
Position-Specific Details:
Appointment Type: Probational, Promotional, or Job Appointment. The person hired for this position is expected to regularly report to the Baton Rouge office. Current permanent classified state employees may be required to accept a probationary appointment, if selected.
Career Progression: This position does not participate in a Career Progression Group.
Work Schedule: Work days are Monday - Friday; work hours will be determined.
Compensation: The salary offered will be determined based on qualifications and experience.
