About the Role

OpenLoop’s mission is to bring care anywhere by powering telehealth solutions at scale. As the Marketing and Advertising Counsel you will serve as a key legal partner to our Growth, Marketing, Product, and Clinical teams by providing guidance on advertising, promotion, and consumer-facing healthcare content across a rapidly scaling digital health platform.

You will be responsible for reviewing and advising on marketing and promotional materials to ensure compliance with FTC, FDA, and healthcare regulatory requirements, while balancing business growth, customer experience, and risk mitigation. This role is ideal for someone who thrives in a fast-paced, highly collaborative environment and enjoys translating complex regulatory concepts into practical, actionable guidance.

 

What You'll Do

  • Serve as a legal subject matter resource on advertising, promotion, and marketing compliance matters related to healthcare, telehealth, pharmacy, wellness, and FDA-regulated products/services.

  • Partner closely with Marketing, Growth, Product, Clinical, and Compliance teams to review and advise on consumer-facing materials across multiple channels, including:

    • Paid media (Google, Meta, TikTok, etc.)

    • Website and landing pages

    • Social media content

    • Email/SMS campaigns

    • Podcasts and video content

    • TV/radio spots

    • Influencer and affiliate marketing

    • Promotional campaigns, contests, and sweepstakes

  • Participate in and support a collaborative legal/compliance/marketing review process that enables scalable and compliant campaign execution.

  • Provide practical, business-oriented legal guidance balancing regulatory requirements with growth and speed-to-market objectives.

  • Help develop and maintain marketing and advertising compliance playbooks, templates, and guidance materials for internal teams.

  • Monitor and advise on changes in FTC, FDA, telehealth, privacy, and healthcare advertising regulations, enforcement actions, and industry trends.

  • Conduct trainings and provide ongoing guidance to internal stakeholders on marketing compliance best practices.

  • Identify potential regulatory or reputational risks in campaigns and partner cross-functionally to develop solutions.

  • Support strategic initiatives involving new healthcare offerings, products, and partnerships from a marketing and advertising compliance perspective.

  • Other duties as assigned.

 

Who You Are

  • Juris Doctor (JD) from an accredited law school and active membership in good standing with at least one U.S. state bar.

  • 4–7+ years of experience practicing FDA, FTC, healthcare regulatory, advertising, or promotional law, preferably within healthcare, digital health, telehealth, pharmacy, wellness, or consumer health industries.

  • Strong knowledge of FTC advertising regulations, FDA promotional guidance, and healthcare marketing compliance requirements.

  • Experience advising on consumer-facing healthcare or regulated-product marketing across digital and traditional media channels.

  • Strong business judgment with the ability to provide practical, solutions-oriented guidance in fast-moving environments.

  • Excellent communication and stakeholder management skills with the ability to collaborate effectively across legal, marketing, product, compliance, and executive teams.

  • Highly organized and detail-oriented, with the ability to manage multiple projects and deadlines simultaneously.

  • Comfortable operating independently in a rapidly scaling organization.

  • Experience building scalable review processes, templates, or operational guidance preferred.
