The Commission, Coastal and Administrative Section is responsible for representing various commissions and boards, such as the Environmental Management Commission, the Coastal Resources Commission, and the Marine Fisheries Commission. The section also represents the Department of Environmental Quality (DEQ) and its divisions and units in cases arising under the Coastal Area Management Act (and related acts), the transfer of surface water between river basin, and in personnel matters. It also handles the collection of civil penalties assessed by DEQ and administers the Attorney General’s Environmental Enhancement Grant program.

This position is responsible for representing all aspects of administrative and civil litigation, legal advice in non-litigation matters, and legal advice to the citizen commissions at regular meetings. The position also prepares and argues criminal appellate cases, responds to inquiries and requests for legal assistance from the General Assembly, the Governor, and other public officials, and responds to public inquiries. The position provides essential services to DEQ and the Attorney General’s Office related to matters in litigation, and non-litigation matters, including serving as the lead attorney responsible for advising DEQ regarding personnel matters.

This position requires travel, including overnight travel, as part of its assigned duties.

Work Schedule:
The regular work schedule is from 8:00 AM to 5:00 PM, Monday through Friday. The caseload and other responsibilities may occasionally require that additional hours be worked. Hybrid telework opportunities are available for this position.

Note to Current State Employees:
The salary grade for this position is LG08. State employees are encouraged to apply for positions of interest even if the salary grade is the same as, or lower than, their current position. If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result.


THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO THE RECRUITMENT RANGE OF $84,878 to $105,336. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

Qualifications

Knowledge, Skills and Abilities / Competencies

Thorough knowledge of environmental case, statutory, regulatory and common law is required, with an additional emphasis on State and federal requirements for the protection of water quality, administrative and criminal law.
Thorough knowledge of judicial and quasi-judicial procedure is necessary.

The attorney must possess the ability to:
conduct civil or criminal litigation in trial and appellate courts;
interpret and apply laws, constitutions, statutes, regulations, court decisions, legal principles and other precedent;
analyze facts, evidence, legal principles and legal instruments;
express arguments and conclusions clearly and logically in oral and written form;
recognize significant issues and creatively develop strategy and tactics in case;
analyze legal problems and render informal and formal opinions;
and establish and maintain effective working relationships.

Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

Management preferences: Management prefers a candidate with experience representing independent government boards and commissions, familiarity with Roberts’ Rules, and experience with environmental litigation and programs. Familiarity with the State Personnel Act and personnel litigation experience is also preferred.
