Position Overview:
As a Senior Counsel – Labor and Employment, you will provide comprehensive advice and counsel on all aspects of labor and employment law, ensuring compliance with a wide range of federal and state employment laws, including the NLRA, Title VII of the Civil Rights Act, ADA, ADEA, FLSA, and FMLA. You will also advise on employee benefits issues and may be called upon to support other commercial or regulatory legal matters or projects as needed. This position reports directly to the Associate General Counsel.
This position is based at our Corporate Headquarters in downtown Houston, Texas, and may require travel to Port Arthur, Texas, and other various sites as needed.
Responsibilities:
Serving as the subject matter expert in all areas of US labor and employment laws, ensuring compliance with all applicable employment practices, laws, rules, and regulations. Providing general legal support to Motiva’s Human Resources Department.
Advising on federal and state labor and employment laws, including the NLRA, Title VII of the Civil Rights Act, ADA, ADEA, FLSA, OSHA, FMLA, and comparable state statutes.
Providing advice and counsel on a wide range of workplace issues, including recruitment, employee relations, accommodations, employee leave, investigations, performance management, separations, employment agreements, reductions-in-force, employment policies, and employee benefits.
Offering guidance on traditional labor law matters, including union elections, collective bargaining, unfair labor practice proceedings, labor arbitrations, and general labor relations.
Interacting with federal and state regulatory agencies, including the DOL, EEOC, and NLRB.
Representing and defending the company as necessary in employment disputes, including responding to demand letters and administrative charges and managing employment litigation.
Identifying options for achieving client objectives within applicable legal restraints and working cooperatively toward legal resolutions.
Communicating with clients and updating them on significant developments in the law.
Engagement and management of external counsel where outside expertise is necessary.
Experience and Qualifications:
Required Education and Experience:
JD from an accredited US law school with a license to practice law in the State of Texas.
5+ years of relevant experience gained at a law firm and/or in-house.
Excellent research, writing, analytical and organizational skills.
Working knowledge of federal and state employment and labor laws, including the NLRA, Title VII of the Civil Rights Act, ADA, ADEA, FLSA, and FMLA as well as a basic familiarity with ERISA
Attention to detail and time management skills.
Flexibility to work in fast paced, high-energy environment and manage multiple competing priorities within challenging timeframes.
Demonstrable record as someone who can coordinate with a variety of stakeholders to deliver on business objectives.
Excellent interpersonal and relationship building skills including the ability to interact with all levels of staff and management.
Preferred Education and Experience:
A mix of law firm and in-house counsel experience.
Familiarity with business transactions, including M&A.
Experience handling employment arbitration and litigation.
Experience assisting with corporate compliance activities, including training and investigations.
