STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO THE RECRUITMENT SALARY RANGE OF $84,878 to $103,184. DOT funded. Salary offers are based upon the candidate's education and experience related to the position, as well as departmental budget and equity considerations.
This position is not subject to the Fair Labor Standards Act.
Provision of Legal Services to Department of Transportation in Highway Condemnation Matters.
The Attorney III represents the N.C. Department of Transportation in eminent domain actions. The attorney has responsibility for all phrases of litigation in land acquisition proceedings, including investigation, trials in the superior courts, and appeals to the Court of Appeals and the Supreme Court. The attorney provides legal advice and representation to the Right of Way Branch with respect to questions of law involved in appraisal and valuation of properties.
The primary duty of an attorney in this position is to represent the Department in eminent domain actions for the acquisition of real estate for highway purposes in cases where the Department’s Right of Way Branch has been unable to effect settlement with landowners, and legal proceedings have to be instituted. This position will require travel throughout the State to perform the duties.

If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result.

- Minimum Education and Experience Requirements
Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.
