Job Description
The Division of Enforcement is seeking a Trial Attorney (Distributions Trial Attorney) in Office of Distributions. The Office of Distributions is responsible for returning money to harmed investors obtained through enforcement actions where a disgorgement fund exists, or a Fair Fund is created pursuant to the Sarbanes-Oxley Act of 2002.
Duties In this role as a Distributions Trial Attorney, you will be responsible for: Conducting litigation, implementing all distributions aspects of civil and administrative proceedings assigned by the Division, and making Commission recommendations for distribution plan approval. Managing and handling litigation issues resulting from challenges to distribution plans by preparing motions and memorandum in support to amend final judgments, or to modify distributions plans. Providing legal advice and assistance to management and staff of the Enforcement Division, including the negotiation and settlement of pending cases and obtaining information for potential distributions. Providing oversight for, or directly participating in the distribution of monetary recoveries from judgment and administrative orders. Working with the Division of Economic Risk and Analysis to formulate economic allocation methodologies that reflect the harm caused by the underlying securities law violations. Serving as an internal fund administrator. Selecting and supervising third-party administrators in the development and implementation of distribution plans that are fair and reasonable. Salary- $161,608 - $292,300/year
