In our continued mission to deliver the best value, experience and opportunity for our communities, stakeholders and partners using customer insights and experience, we are seeking a Senior Counsel who will play a crucial role in the drafting, reviewing and negotiation of leases with a focus on food and beverage leases, as well as ground leases. This position will report directly to the SVP, Associate General Counsel with geographic flexibility to work remotely offered by Tanger’s hub-and-spoke approach to a modern Teams-driven workplace.

About the Role:

In addition to drafting and reviewing leases, as the Senior Counsel you will perform legal research and interpret existing legal documents to determine the legal rights and obligations of the Company. You will also assist with negotiating non-lease related and lease management related documents.

How you will contribute to what we do:

  • Review document request received from leasing department, verify inconsistencies on such lease request with leasing representative and/or legal management and obtain all required approvals.
  • Prepare document based on the document request, gather information needed, research and incorporate prior negotiated language (confirm any nonconforming language with the leasing representative and legal management) and include all necessary language to address all issues.
  • Negotiate the open business and legal points with tenant’s legal contact and obtain internal approvals of negotiated solutions with leasing representative and legal management, as necessary.
  • Revise document based on negotiations and direction from our representative and legal management, as necessary.
  • Review tenant executed document to ensure the form and content reflect negotiations and approvals and commence document execution process.  If through this review and execution process language or exhibits need to be changed, obtain necessary approvals prior to execution by the Company.
  • Review lease documents and provide legal drafting guidance drafted by Senior Paralegal and Associate General Counsel I
  • Review requests for legal documents from Leasing and other various departments or provided forms and follow up with department representative to clarify scope of projects.
  • Prepare or revise documents to address all legal and business concerns important to the department representative and the Company.
  • Negotiate the open business and legal points with the other party’s legal contact and obtain appropriate internal approvals of negotiated solutions with department representative and legal management.
  • Revise document based on negotiations and direction from department representative and legal management, as necessary.
  • Discuss business points with leasing representative and offer suggestions to address both tenant’s concerns and the Company’s interests.

About You:

  • A J.D. from an accredited law school, license to practice law in one state, and nine (9) plus years of drafting and negotiation of retail leases is required. Documented experience in food and beverage, and ground leasing is also required.  
  • Preference will be given to individuals who meet the requirements of the role and are a graduate of a top 50 law school.  Nine (9) plus years of drafting and negotiating retail leases in-house with landlords or tenants is also preferred.
  • You can identify, interpret, and apply the results of your research.
  • You have experience handling multiple projects, prioritizing workflow, are detail oriented and can meet deadlines, problem solve and work independently as well as in a team.
  • You are competent to make sound decisions on various substantive areas of contract and lease principles and law without significant managerial oversight.
  • You keep all privileged information confidential except when required by law.

Hiring Range Disclaimer

The base salary range represents the low and high end of the hiring range for this position. Actual salaries will vary depending on factors including but not limited to location, experience, and performance. The range listed is just one component of Tanger's total compensation package for employees.

Targeted Hiring Range: $170,500 - $205,000 per year
