The Role

 

OOCL has established a new Risk & Compliance department. Leading this department will be the In-House Counsel. OOCL’s line of business requires the understanding of maritime laws, laws of different local jurisdictions, and an understanding of specific regulatory regimes including FMC (Federal Maritime Commission) here in the US. We are seeking an individual who is well-versed in contract law and some knowledge of FMC regulations. If you are not familiar with maritime law, our regional leader and direct manager over the role is happy to provide guidance to bridge the knowledge gap with his legal background.

 

Summary of Responsibilities:

 

Commercial Contracts

  • Draft, review, and negotiate contracts, agreements (service contracts), and other legal documents
  • Customer boilerplate negotiations
  • Vendor/Supplier contracts
  • Handling contracts with our sister company, OOCL Logistics (end-to-end supply chain service provider)

Legal & Compliance

  • Provide legal advice and guidance to OOCL North America Group companies
  • Advise management regarding compliance with maritime & government regulations
  • Work with FMC and CBP (Customs & Border Protection) for C-TPAT (Customs-Trade Partnership Against Terrorism) certification, including regularly scheduled meetings with FMC
  • Partner with external counsel on outstanding litigation cases, managing the litigation cases and being the bridge to corporate in Hong Kong as needed
  • Represent the company in legal proceedings, including court cases and arbitration
  • Ensure company compliance with all applicable laws, regulations, and industry standards

Process Improvement & Issue Prevention

  • Work with the R&C team to identify potential risks and gaps, proactively resolving them before they become an issue
  • Identify and manage legal risks associated with business operations and transactions
  • Facilitate and evaluate legal claims and litigation across departments and provide input on dispute resolution.

Qualifications:

  • Juris Doctor from an accredited law school
  • Licensed in at least one US jurisdiction
  • 3 – 4 years of licensed legal experience
  • Experience in drafting & reviewing legal documents
  • Experience with insurance claims, mediate disputes, and enforce regulations
  • Strong knowledge of corporate law principles & regulatory frameworks
  • Excellent communication, negotiation, and analytical skills
  • Ability to manage multiple projects & deadlines effectively
  • Ability to work independently & as part of a team
  • Familiarity with relevant legal technology software

Preferred Skills:

  • Familiar with international conventions and treaties
  • Well versed in international federal state laws as well as specific maritime regulations
