Job Description:

Job location is the Nebraska State Office Building, Downtown Lincoln.

Salary will commensurate with education/or experience, if approved within fiscal constraints


 

Primary emphasis will be on formulation of DOR policy, researching and drafting regulations, revenue rulings, complex tax-related inquires, research and interpretation of sales and income-tax related issues, and similar work. Draft and review tax forms, revenue rulings, and information guides related to mandates and interpretations of the state's revenue laws.

2. Draft and prepare correspondence, regulations, legislation, and other legal documents and provides technical legal assistance to other agency staff, agency management, and staff of the legislative and executive branches.

3. Conduct legal research and investigates issues to ensure information is gathered for responding to tax-related inquiries and to facilitate the administration and enforcement of agency statutory authority.

4. Confer with Policy Manager and other agency staff, practitioners, and taxpayers to exchange and prepare information on facts and issues of technical tax-related inquiries or issues.

5. Represents DOR in meetings with practitioners, taxpayers, and other interested parties related to the interpretation and application of revenue laws and agency rulings, regulations, and administrative positions.

6. Interprets and applies court decisions and administrative rulings to respond to technical inquiries from taxpayers, practitioners, and other interested parties, and to ensure adherence to them by DOR staff.


 

Requirements / Qualifications:

Minimum Qualifications: Three years of experience as an attorney practicing law and providing legal services such as preparing and trying cases, advising clients, and/or interpreting laws or administrative policies. 

Legal Requirements: In accordance with Section 7-101, Nebraska Revised, Reissued Statutes of l943, incumbents in this class must be admitted to the Nebraska Bar. 

Preferred Qualifications:  Candidates with experience in the area of tax law and administration or legislation and knowledge/experience in developing, analyzing, or otherwise working with tax issues related to the areas of individual and business income tax and sales tax. Additional preference given to candidates with Department of Revenue tax policy related experience including preparing and drafting legal documents and tax forms.

Candidates MUST attach a copy of their resume' to ensure familiarity and experience with income and excise taxes.

Knowledge of: State and/or Federal statutory and case law and constitutional provisions pertinent to DOR programs; the techniques of preparing/drafting legal documents and forms; the principles and practices of legal research; the principles and practices of civil law administration; the organizational structure, functional relationships and legal processes of the legislative/administrative bodies of Nebraska.

Skills in: Performing legal research; drafting various legal documents; including regulations, rulings, and legislation; negotiating with public and other professionals, such as attorneys, accountants, etc; analyzing and reviewing legal issues and making recommendations.

Ability to: Prepare and communicate the facts and arguments relating to technical legal issues and persuade others to accept the viewpoint presented; communicate effectively to summarize and exchange legal findings and conclusions; interact with legal associates, other governmental employees, the public, and representatives of parties involved in technical legal issues; formulate legal opinions and recommendations based on legal research and investigations; conduct legal research and investigations; identify critical elements of legal questions or issues; prepare/draft statutes, regulations, and other legal documents; interpret and apply statutes, case law, decisions of court/administrative hearings, and administrative rules and policies.
