THE STARTING SALARY FOR THIS POSITION IS LIMITED TO $87,849 to $99,216 . Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

This position is an excellent opportunity for an attorney who is looking for a balance of non-litigation and litigation duties. The position will provide legal advice to the Secretary of State, State Auditor and NC Rural Electrification Authority on a variety of interesting and novel topics. Such topics in the past have included - immigration and the electoral college. The litigation in this position will involve a variety of subjects, including the State’s notary laws and the powers of the State Auditor’s Office, and will require appearing at the Office of Administrative Hearings, and in State and Federal courts.

The primary purpose of this position is to render litigation assistance to the North Carolina Department of the Secretary of State and to the various divisions of the Department of the Secretary of State.

This attorney will assimilate the facts, research the law, and prepare pleadings, motions, discovery and other legal documents required for judicial and administrative proceedings. This attorney will conduct and defend depositions. This attorney is also responsible for court appearances at the trial and appellate level and for negotiating settlements as appropriate and in most instances operates with maximum independence.

This position works alongside the attorneys in the Insurance Section, which is a part of the Civil Division. The Civil Division is committed to providing opportunities for development through the sharing of expertise and knowledge across the six different sections of the Civil Division.

Advice and Counsel to the Department of the Secretary of State, the Office of the State Auditor, the North Carolina Rural Electrification Authority and other client agencies of the Civil Division

This attorney provides advice to the North Carolina Department of the Secretary of State, the various divisions of the Department of the Secretary of State, the North Carolina State Auditor, and the North Carolina Rural Electrification Authority. In addition, this Attorney may be called upon to provide advice to other client agencies of the Civil Division. Legal work undertaken by the attorney in this position involves all areas over which these client agencies have regulatory authority.

Department Information:

The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the state, state agencies, and elected officials, and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally, the Department of Justice includes the North Carolina State Crime Lab the North Carolina Justice Academy and the Sheriffs’’ and Criminal Justice Education and Training Standards Divisions.

Qualifications

Knowledge, Skills and Abilities / Competencies

  • Considerable knowledge of case, statutory, regulatory, common law, judicial and quasi-judicial procedures.
  • Ability to conduct complex civil or criminal litigation in trial and appellate courts, interpret and apply laws, constitutional provisions, statutes, administrative regulations, and court decisions, analyze facts, evidence, and legal instruments.
  • Ability to express conclusions and arguments clearly and logically in oral and written form, analyze legal problems and render formal opinions, and ability to establish and maintain effective relationships.
Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience.

Applicants seeking National Guard Preference must attach a NGB 23A (RPAS) if you are a current member of the NC National Guard in good standing. If you are a former member of the NC National Guard who served for at least 6 years and was discharged under honorable conditions, you must attach either a DD256 or NGB 22.
