Job Overview:
HNS Recovery, a leading vehicle repossession company, is seeking a skilled and licensed attorney to join our team as an In-House Legal Consultant. The ideal candidate will have experience in commercial law, compliance, and repossession regulations. This role will involve advising on legal matters related to repossession, ensuring compliance with state and federal laws, and managing litigation and risk.
Key Responsibilities:
- Legal Advisory: Provide legal counsel to the company on all matters related to vehicle repossession, contract disputes, and commercial litigation.
- Compliance: Ensure company operations comply with applicable state and federal laws, including but not limited to the Fair Debt Collection Practices Act (FDCPA) and Uniform Commercial Code (UCC).
- Contract Management: Draft, review, and negotiate contracts and agreements, ensuring they protect the company's interests.
- Litigation Management: Oversee and manage legal disputes, liaise with external counsel, and ensure effective resolution of litigation related to repossession and consumer disputes.
- Regulatory Affairs: Stay up to date on changes in repossession law, consumer protection laws, and other relevant regulations, providing guidance to the company to adapt as necessary.
- Risk Mitigation: Identify potential legal risks, develop strategies to mitigate them, and assist in the implementation of company policies that minimize legal exposure.
Qualifications:
- Juris Doctor (JD) degree from an accredited law school.
- Active and valid law license in Texas
- Strong understanding of state and federal repossession laws and regulations.
- Proven experience in managing litigation and contract negotiation.
- Excellent analytical, problem-solving, and communication skills.
- Ability to work independently and manage multiple legal matters simultaneously.
Preferred Qualifications:
- Experience in the vehicle finance, recovery, or repossession industry.
- Knowledge of the Fair Debt Collection Practices Act (FDCPA) and Uniform Commercial Code (UCC) regulations.
