KEY JOB RESPONSIBILITIES:
· Review and negotiate master services agreement, vendor contracts including equipment, medical supplies, professional services, education affiliation agreement with colleges and universities, software, and construction arrangements, as well as consulting and nondisclosure agreements. Provide counsel and guidance regarding the impact of terms on DCH operations. Establish contract management system for legal department.
· Provide counsel and guidance regarding HIPAA, healthcare arrangements and other health information matters.
· Assist with compliance and risk management departments.
· Provide subpoena and litigation support on a variety of issues for departments.
· Provide counsel on the Stark law, anti-kickback statute, civil monetary penalties law and other fraud and abuse matters. Additionally, research and advise on Medicare and Medicaid regulatory issues
· Assist with transactions based on level of experience including acquisitions, clinically integrated network (CIN), physician compensation arrangements, and other hospital arrangements.
· Provide in-depth analysis, research, presentations, and support for legal issues.
· Identify and assess legal risks and opportunities within the labor and employment arena and advise accordingly.
· Educate client and stakeholders on legal/regulatory matters, policies and procedures.
· Provide timely and effective legal services.
· Provide on-going support to Chief Legal Officer for a variety of legal needs.
Department Specific Job Details:
Education:
Undergraduate and post-graduate degrees, specifically a juris doctorate degree from an accredited law school.
Experience:
Minimum of 4 years’ experience, preferably some in healthcare law.
Must have a working knowledge of interpretation and application of State, Federal, administrative and regulatory laws and general legal issues that affect healthcare entities and related services.
Must be able to speak with, coordinate, provide guidance to, and legal assistance throughout the organization, as well as collaborate with retained outside legal counsel.
Licensure, Certifications, Registrations:
Must be a licensed attorney in the state of Ohio.
Must maintain memberships with local and state bar associations.
Must maintain memberships with state and national healthcare associations.
