General Responsibility
Under limited supervision, interprets and implements legal requirements of the Ethics Act; prepares advisory opinions; and prosecutes complaints.The Ethics Act requires specific governance of public officials, public members, and public employees. The Act also requires the filing of financial disclosures by certain individuals under the Commission’s jurisdiction. When these filings are not compliant with the Act, fines and/or investigations can be initiated for compliance and enforcement. Additionally, the Act requires enforcement of code of conduct violations. Upon conclusion of investigations by the Investigations and Enforcement Division, presentations are made to the Commission, consisting of eight members which convenes monthly, for applicable determinations.
Specific Responsibilities- Coordinate complaint investigations and prosecute violations of the Ethics Reform Act.
- Conduct training sessions on the roles and responsibilities of public officials, public members, and public employees under the Ethics Reform Act.
- Furnish legal advice to the Executive Director, Commission, and staff relevant to interpreting and implementing the Ethics Reform Act.
- Researches and drafts formal advisory opinions for presentation at Commission meetings.
- Researches and drafts informal advisory opinions for public officials, public members and public employees.
- Handle Commission responses to Freedom of Information Act requests.
- Other duties as required.
- Minimum and Additional Requirements
Juris Doctorate Degree or its equivalent from an accredited law school and experience as a practicing attorney.
Must be a member of the South Carolina Bar and admitted to US District Court for the District of South Carolina.- Preferred Qualifications
In depth knowledge of the laws of South Carolina. Knowledge of general case, statutory and common law, especially in the area of ethics law and the Administrative Procedures Act. Knowledge of judicial and quasi-judicial procedures and rules of guidance. Ability to interpret and apply laws in court decisions. Ability to analyze facts, evidence and legal documents. Ability to express conclusions and arguments clearly and logically. Ability to plan and direct staff in legal activities. Expected to argue and represent the State Ethics Commission before State and Federal Courts and Administrative agencies.
