THE STARTING SALARY FOR THIS POSITION IS LIMITED TO $92,917 - $132,790. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.The Attorney IV independently represents the Department of Transportation in eminent domain litigation at the highest levels of complexity, economic impact, and monetary exposure.
The Attorney IV has responsibility for all phases of litigation in land acquisition proceedings, including investigation, discovery, trials in the Superior Courts, and appeals to the Court of Appeals and the Supreme Court. In addition, the Attorney IV provides legal advice and representation to the Right of Way Branch with respect to questions of law involved in appraisal and valuation of properties.
Complex Litigation. The primary duty of the Attorney IV is to independently represent DOT in the trial of complex eminent domain actions for the acquisition of real estate for highway purposes in cases where the DOT’s Right of Way Branch has been unable to effect settlement with landowners and legal proceedings have to be instituted. Unlike the Attorney III’s in the Condemnation Unit who are assigned cases in one specific or area, the Attorney IV is assigned cases throughout the state where the deposit or likely jury verdict exceeds approximately $500,000 or involves questions of first impression or legal strategies or tactics not used in routine condemnation cases. Technical issues and subjects that arise require research and specialized understanding in order to handle the case successfully.
Miscellaneous duties. The Attorney IV must also prepare various legal documents for the Department, including deeds, releases, disclaimers, contracts, and other instruments of a similar nature. Additionally, opinion letters, both formal and informal, to various state and local governmental officials must be prepared upon an appropriate request and assignment from the attorney’s supervisors.
Representation of the State in criminal appeals. The Attorney IV prepares briefs for the State in criminal appeals to the North Carolina Court of Appeals and Supreme Court. Preparation of the brief requires reading and summarizing a trial transcript, reading the defendant’s brief and the authority cited, researching relevant other authority and writing arguments on the questions raised.- Knowledge, Skills and Abilities / Competencies
Management Preferences: In general, the knowledge, skills and abilities required for the Attorney IV are those for the general practice of law with emphasis on litigation, that is, maintain effective working relationships with clients, witnesses, colleagues, court officials, judges, and jurors. Thorough knowledge of condemnation case law and civil procedure is required as well as the demonstrated ability to analyze complex facts and evidence. Ability to conduct complex litigation in trial and appellate courts, including the ability to creatively develop case strategy and tactics, is required, and ability to oversee paralegals and less experienced attorneys who may assist in trial preparations and at trial is necessary.

Licensed to practice law by the North Carolina State Bar and four years of progressively responsible professional legal experience.
