Position Summary
The Employment Counsel and Sr. Director of People is a dual-role leadership position charged with shaping a compliant, efficient, and high performing workplace across multi-state operations. This position requires a blend of employment law expertise primarily in California law with strategic Human Resource leadership and human capital management in relation to H&S Energy Group’s multi-site gas station and convenience store operations with close to 300 locations throughout California, Nevada, Oregon and Washington. You will serve as a trusted advisor to company leadership on all employment-related matters while also leading compliance, safety, and employee relations initiatives for the Human Resources Department.
Responsibilities and Duties:
- Provide day-to-day legal counsel to HR and business leaders on a wide range of employment matters, including hiring, performance management, discipline, terminations, accommodations, leaves of absence, and wage and hour compliance.
- Raise proactive HR and legal issues with leadership, recommend practical, compliant action plans and processes to address workplace concerns, and drive processes to improve compliance.
- Lead, supervise, manage, and evaluate the Human Resources department to create a structure to scale the business and achieve continual improvement of the efficiency and effectiveness of the department.
- Lead cross-functional people-centered projects taking into account legal impacts and business strategies.
- Identify workforce trends and proactively address root causes through policy updates, training, program development, and organizational improvements.
- Internal handling of investigations, and pre-litigation matters with emphasis on achieving a pre-filing resolution.
- Manage workers’ compensation claims and claims management, working to identify safety concerns and mitigation efforts.
- Provide legal and compliance advice across a wide range of issues, including employee relations; restructuring, redundancies, and outsourcing; equal opportunities and diversity; employee accommodations and interactive processes; employment litigation; mergers, acquisitions, and divestitures; drafting of employment separation agreements; wage & hour obligations and compliance.
- Retain and work effectively with outside counsel where required and manage external counsel contracts to reduce costs and secure value-added services as appropriate.
- Draft and maintain employment policies, handbooks, and internal procedures to ensure alignment with legal requirements and organizational needs.
- Keep abreast of relevant legal developments across the US, specifically focused in California and Oregon labor law. Drive consistent enterprise-wide standards for Labor and Employment support.
- Develop and deliver targeted training to HR, leadership and operations teams on employment law compliance, best practices and risk mitigation.
- This position dual reports to the Company’s General Counsel and the President of Operations.
Education and Work Experience
- J.D. from an ABA-accredited law school and an active member of the State Bar of California (or ability to register as in-house counsel in California).
- Minimum of 10+ years of progressive related experience in labor and employment law. Prior in-house experience and Human Resources certifications (e.g. SHRM) preferred.
- Extensive “hands-on” legal experience with providing advice and counsel and handling employee relations matters, either in legal or HR matters, with proven ability to provide practical advice and solutions that balance legal risk and business priorities.
- Ability to assess organization and industry trends and implement HR solutions.
- Proven experience counseling clients on L&E issues, litigation, and training.
- Excellent judgment, discretion, and ability to handle sensitive and confidential matters.
- Exceptional communication and interpersonal skills with the ability to build trust across all levels of the organization.
- Strong organizational skills with the ability to manage multiple priorities in a fast-paced environment.
- Must be able to roll op sleeves to operate at all levels and address the current demands of a multi-location business.
- Background in retail operations preferred but not required.

- Business acumen with strong leadership and management skills.
- California Labor Law and HR expertise.
- Record of dedicated and successful teamwork, excellent interpersonal abilities.
- Advanced computer and research skills, spreadsheet experience.

- While performing the duties of this position, the incumbent is regularly required to talk or hear.
- The employee will be required to be onsite 100% of the time, at the corporate offices in Orange, California. Remote work should be on a case by case basis, including evening & weekend work, but regular hours (40+) must be done at the Corporate Office.
- The noise level in the work environment is usually moderate.
- The employee frequently is required to use hands, fingers, handle or feel objects, tools and controls.
- The employee is occasionally required to stand; walk; sit; reach with hands and arms; climb or balance; and stoop, kneel, crouch, or crawl.
- The employee must occasionally lift and/or move up to 25 pounds.
