Job Description

Office of the Director, Anti-Fraud Unit

Under the general direction of the Chief Counsel of the Office of the Director Legal Unit (OD-Legal), and the Assistant Chief Counsels, Attorney III represent the Director of the Department of Industrial Relations, the Department, and division chiefs and managers in a wide and interesting variety of subject areas that are within the responsibility and jurisdiction of the Department. Attorney III generally have mid-level experience, and are expected to independently handle a caseload, to have solid lawyering skills, and to have some level of subject matter expertise in or more areas of the Department's responsibility.

Duties may include but are not limited to:

  1. Representing the Department, Director, or Administrative Director of the Division of Workers' Compensation in all Anti-Fraud Unit matters, including but not limited to provider suspension and special lien adjudication matters
  2. Representing the Department, Director, or one of DIR's divisions in civil and writ litigation, including litigation involving constitutional issues
  3. Representing the Director of DIR in workers’ compensation cases involving special funds administered by the Director
  4. Analyzing and drafting proposed legislation
  5. Providing legal services with respect to contract matters involving the Department
  6. Drafting proposed regulations
  7. Providing legal services on a wide variety of other issues that may arise in the operation of the Department.

Qualifications

Desirable Qualifications

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:

  • Knowledge concerning the work of the Department, workers' compensation law, anti-fraud law, and/or laborand employment laws.
  • Prior experience serving as counsel to a public agency.
  • Prior experience writing and filing briefs in the California Court of Appeal and/or California Supreme Court.
  • At least five years of prior civil litigation or administrative law experience.
  • Prior experience analyzing and working on legislation and/or administrative regulations.
  • Strong interpersonal skills and the ability and desire to contribute to a collegial office environment.
  • Proficiency in Word and other Microsoft applications, case management system and Westlaw.

Knowledge:

  • Attorney III must have at least five years of experience in the practice of law.
  • Prior experience in one or more of the following areas: workers' compensation litigation, anyaspect of labor and/or employment law, public entity representation, or criminal, civil or administrative litigation.
  • Must have knowledge of lawyering practice, procedure, and skills, including knowledge of civil procedure and evidence, discovery techniques, witness examination, oral advocacy, legal research methods, case citation format, court filing procedures, and other skills necessary to perform competently and independently as a mid-level attorney.

Skills:

  • Must be able to research and analyze legal issues.
  • Must be able to independently analyze legal issues and come to a conclusion for purposes ofrecommendingaction to the Department.
  • Must be able to consistently and timely generate well-written legal briefs and other written work products.
  • Must be able to consistently present legal arguments, both orally and in writing, in a clear, organized,andpersuasive manner.
  • Must be able to present evidence in a clear, organized, and persuasive manner, including by the examinationofwitnesses and introduction of exhibits.

Abilities:

  • Must be able to consistently perform competently, independently, and professionally as a mid-level attorneywithminimal supervision, exercising discretion and good judgment.
  • Must be able to communicate effectively and professionally with opposing counsel, courts, clientrepresentatives,coworkers, and the public.
  • Must be able to organize and manage a high volume of work and perform in potentially stressful situations.
  • Must be willing and able to accept supervision and direction from management and Department leadership.
  • Must be able to appear in civil and administrative courts, and travel as assigned (for short duration trips, within California).

Must be a member of the California Bar and qualified to practice law in California. The minimum requirements are defined in the Classs Specification for Attorney III.

Working Conditions

This position is located in:
Oakland

This is a full-time position headquartered in the Office of the Director, Anti-Fraud Unit, located in an office environment in the 22-story State office building located at 1515 Clay Street, Oakland, California. This unit is currently located on the 7th floor. Employees in this position have their own offices, work at desks, and are required to work extensively on computers as necessary for the drafting of letters, briefs and other documents, and for research, email communication, file review, training and other purposes. Attorneys are expected to handle their own word processing, and secretarial support is generally limited to the finalization and filing process. This position requires occasional in-state travel, either locally within the Bay Area, or for one to three day overnight trips within California, based on assignments, and as determined according to the needs of the Department. This is a full-time, Monday through Friday, position. Attorneys are expected to work all hours as necessary to accomplish their assignments, and although they will generally average a 40-hour week, longer work hours may occasionally be required. There is some flexibility as to the specific work schedule, which will be determined after hire in consultation with the Chief Counsel or Assistant Chief Counsel.
