Job Duties
The Department of Labor and Industry’s Division of Hearings and Legal Services at the Headquarters Office is seeking a self-motivated individual to serve as full time litigation lead counsel in VA Occupational Safety & Health (VOSH) contested cases in circuit courts, when appointed by the Commonwealth’s Attorney as Special Assistant. This position also researches and analyzes legal issues upon request from agency divisions to facilitate compliance efforts under applicable laws, regulations and standards, presents findings and recommendations to agency management personnel resulting from the legal research and analysis of technical issues and data, and handles more complicated/difficult cases. In addition, this position provides legal and technical support in the development of standards, regulatory rulemaking, policy formulation, and legislative affairs of all agency divisions. This position is partially funded from Federal Grant Sources and continuation is dependent upon the availability of funds.

Minimum Qualifications
• Knowledge of Virginia Rules of Civil Procedure and the Virginia Administrative Process Act.
• Excellent verbal and written communication skills.
• A J.D. degree.
• An active membership in the Virginia State Bar.
Additional Considerations
• Litigation experience is strongly preferred.
• Knowledge of Federal and State laws governing Labor, and Occupational Safety and Health, as well as the ability to conduct research and analysis.
• Experience in a similar position in government or private industry.
• Verifiable fluency in speaking, reading, and writing Spanish.

• Possession of a valid driver’s license or ability to obtain a valid driver’s license.
• Ability to occasionally travel overnight.
• Ability to perform moderate physical activity that includes but is not limited to climbing stairs and ladders, bending, walking up and down inclines, occasionally lifting and carrying loads up to 30 pounds.
• The selected candidate must:
• Successfully complete a criminal background investigation.
• Complete and submit an annual Statement of Personal Economic Interest.
• Successfully complete a physical evaluation through the agency’s authorized health screening vendor, which includes an alcohol and drug screening.
• Successfully serve a 12-month probationary period effective from the date of employment if beginning employment as an original hire or re-employment.
The maximum hiring salary range is $85,000 - $120,000 annually plus the State’s benefits package. The agency will not entertain salary negotiations outside of the hiring range.
