THE STARTING SALARY FOR THIS POSITION IS LIMITED TO $92,917 to $115,937 . Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.
This position is located in the the Tort Claims Section at the North Carolina Department of Justice in Raleigh, North Carolina.This attorney will act as defense counsel for the local boards of education and certain of their employees named in legal actions brought pursuant to Tort Claims Act. This position is assigned to represent the Department of Public Instruction and local boards of education in a variety of matters, including complex, protracted or high profile cases involving school bus accidents. These actions include personal injury jury trials, wrongful death, or property damage claims brought against local boards of education and State employees individually pursuant to the Defense of State Employees Act in both State Court and the Industrial Commission.
The cases assigned to this attorney will be diverse and challenging, and will directly impact the client's legal and fiscal condition. The assignment of these cases contemplates professional and proficient representation during all litigation events including the drafting of pleadings, voluminous discovery, pretrial hearings, trial, and all appeals.
This attorney will further advise the client on all litigation and policy issues, including sensitive and confidential matters. This attorney may further be requested to draft legal opinions or advise the client agencies on risk-management issues. Cases and other position duties will be assigned by the Tort Claims Supervisor or the Litigation Division's Senior Deputy.
The attorney will be expected to work independently, or as assigned, collaboratively with other members of the Tort Claims Section. The attorney will speak at conferences and teach at workshops for individual clients, upon request. The attorney will be required to travel to those locations where the various client matters and litigation are conducted. This attorney will also represent the State before the Court of Appeals and Supreme Court, in both Tort Claims actions and criminal actions.
This position requires overnight travel as part of its assigned duties.

The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the state, state agencies, and elected officials, and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally, the Department of Justice includes the North Carolina State Crime Lab the North Carolina Justice Academy and the Sheriffs’’ and Criminal Justice Education and Training Standards Divisions.

The salary grade for this position is LG09. State employees are encouraged to apply for positions of interest even if the salary grade is the same as, or lower than, their current position. If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result.

Knowledge, Skills and Abilities / Competencies
Extensive and expert knowledge of the N.C. Rules of Civil Procedure, the N.C. Rules of Evidence, the Tort Claims Act, the N.C. Rules of Appellate Procedure, and any other related statute, regulation or code.
Well-versed in legal research and writing, oral advocacy, and overall litigation strategies.
