Job Summary

Deputy General Counsel responsible for litigation management for the company, its affiliates and its captive insurance company, Restoration Risk Retention Group, Inc. (RRRG). Also responsible for general corporate and commercial matters, including contract drafting and review on an as needed basis, Corporate Compliance and Ethics Program, Regulatory and Government Affairs and Compliance Program and supervising the Intellectual Property and Brand Protection Program. Other duties include Franchise advertisement (i.e. print radio tv, and web based), and Territorial Policy guidance and enforcement. Supervises Litigation and Brand Compliance/Protection Paralegals.

Major Duties and Responsibilities

  • Litigation Management:
  • Corporate litigation (including collection lawsuits).
  • Franchise insured defense litigation including when Servpro Industries is named as a defendant for RRRG and non-RRRG insured matters.
  • Franchise litigation.
  • Other business disputes/claims/litigation;
  • EEOC Charges and Employment Litigation;
  • Intellectual Property Litigation;
  • Bankruptcy Litigation;
  • Subpoena and Garnishment Management; and
  • RRRG litigation case portfolio and litigation management program.
  • General Corporate and Commercial Matters
  • Franchise Territorial Policy and Advertisement Guidance and Enforcement
  • Partner on Contract Review and Drafting (including National Accounts and Commercial Accounts) on a as needed basis.
  • Design, Implement and Monitor Corporate Compliance Program (in close partnership with Human Resources)
  • Supervise and Manage Regulatory and Government Affairs Watch and Compliance Program at Federal, State and Local Levels for Identified Key Risk Areas-with Emphasis on Proactive Approach and Effective Communication with Impacted Parties (including Franchises) in close partnership with the Legal Department's Government Relations & Regulatory Affairs Specialist.
  • Supervise Strategic Intellectual Property and Brand Protection Program.
  • Review Servpro Forms and Manuals as Required and Respond to Franchise Questions or Concerns.
  • Provide legal counsel and guidance to the Human Resources Department, Commercial Large Loss Department (including the Storm Team), Field Training, Communications, Marketing, National Accounts, Product Control/Product Sales, Field Operations, Customer Care Center, Information Technology, Blackstone Program, and Accounting on a as needed and case by case basis.
  • Participate in the Company's Enterprise Risk Management Program as a member of the team.
  • Respond to Governmental (i.e. Attorney General) and Quasi-Government (i.e. BBB) Inquiries, Claims, and Complaints.
  • Assist in Leadership and People Development Training in the Legal Department and other Departments on an as needed basis.
  • Supervises litigation and Brand Compliance/Protection Paralegals.

You have

  • Ability to read, write, and speak the English language to communicate with employees, customers, suppliers, in person, on the phone, and by written communications in a clear, straightforward, and professional manner.
  • Licensed, practicing attorney with the ability to obtain membership to the Tennessee Bar, if not already a member.
  • Microsoft Office, including Outlook tasks, Excel.
  • Excellent verbal and written communication and presentation skills, in addition to critical decision-making ability.
  • Proficiency in in-house legal practice with strong business acumen.
  • Demonstrated ability to work on and lead teams across functions is essential.
  • At least ten (10) years of combined experience in both a nationally recognized law firm and in-house corporate practice.

Education

  • Honor graduate from a Top 30 law school.

Working Conditions

  • Fast-paced, high pressure office environment.
  • Standard working hours, based on a 40 hour work week.
  • Additional working hours required as needed to complete testing assignments and projects on schedule.
  • Minimal travel as required for business needs.
