Main Purpose of Job
The main purpose of this position will be to serve as a Special Examiner to the Board of Appeals. This position is essential to address the increased workload of the Board of Appeals brought on by the current economic environment.
POSITION DUTIES
The duties include but are not limited to the following:

Review complex case records of unemployment insurance cases on appeal to the Board and prepare draft decisions for the Board’s signature.

Summarize the contents of hearings as requested by the Board and advise the Board as to the adequacy of the evidence to support the Hearing Examiner’s findings of fact and whether the conduct of the hearing comported with requirements. Screen appeals filed to the Board to determine whether they raise new questions of law, or whether the Hearing Examiner’s decision is affected by new law, possibly violative of Board precedent or inconsistent with any other decisions being issued by the Hearing Examiners or the Board of Appeals. Advise the Board in writing of these findings.

Evaluate all allegations of procedural errors raised by appellants of Hearing Examiner’s decisions, applying a knowledge of the Board regulations, the Hearing Examiner’s legal jurisdiction, constitutional due process of law as it applies to administrative proceedings, United States Department of Labor hearing standards, and internal agency procedures and agency forms, to arrive at a written recommendation and a proposed decision for the Board which adequately addresses and disposes of the issues.

Act as Special Examiner for the Board on occasion to hear difficult and complex cases including Labor Disputes and Employer Account cases, conduction hearing under oath and on the record in accordance with the Board regulations and drafting written decisions for the Board’s signature.

Conduct training for new Board members who are appointed to the Board by the Governor in Board process and procedure and the law as needed and provide training to the staff and other stakeholders as necessary and/or requested.

Liaison with the Office of Lower Appeals to resolve questions as to what documents are properly a part of the record in each case appealed to the Circuit Court. 

Other duties as assigned by the Chairman.
SELECTIVE QUALIFICATIONS

Applicants must meet the selective qualification(s) to be considered. Include clear and specific information on your application regarding your qualifications.

1) Admission to the Maryland Bar.
2) Certificate of Good Standing with the Supreme Court of Maryland.

SPECIAL REQUIREMENTS

Personnel employed in this classification will have access to federal tax information and must undergo a state and FBI criminal background check as a condition of employment.

All candidates are subject to a background check against files maintained by the Division of Unemployment Insurance (MD Labor/DUI) to determine whether any monies are owed to MD Labor/DUI as a result of unemployment insurance overpayment/fraud. Any unpaid debt may have an impact on whether or not a candidate is offered employment.
