Job Description
Duties

The Hearing Examiners will conduct administrative hearings and write decisions in cases involving the professions and occupations regulated by the NYS Department of State. The areas of jurisdiction include but are not limited to real estate brokers/salespersons, cosmetologists, appearance enhancement business owners, notaries public, security guards and private investigators. The incumbents will perform duties that include the following:

• Oversee the development of the official case record through a formal, litigated process; administer oaths; issue subpoenas, as needed; rule on the admissibility of evidence, question witnesses when required; rule on motions; structure hearing presentations; maintain order, decorum and efficiency as a court record.
• Research the record, briefs and the law to analyze legal issues and related legal matters; evaluate evidence; make findings of fact and conclusions of law; peer review of decisions for legal sufficiency and adherence to agency policy and procedures.
• Upon conclusion of administrative proceedings, render final decisions for the NYS Department of State.
• Keep current on rules and regulations, changes to the law, administrative directives, etc.
• Perform other tasks as assigned.

Salary
  • $106,898 - $131,665/year
Qualifications

A law degree and license to practice law in the State of New York. Five years of relevant specialized experience. Two years must have been recent relevant post-bar legal experience.

PREFERRED QUALIFICATIONS:
• Broad array of regulatory law experience, including experience with administrative hearings or litigation, analyzing legal issues, and researching and interpreting complex areas of law.
• Strong oral and written communication skills.
• Proficiency using video conference platforms like Zoom or WebEx.
• Previous experience as an Administrative Law Judge or Hearing Officer is preferred but not required.

For new State employees appointed to graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts.

NOTE ON TELECOMMUTING: The Department of State employees may be approved for a maximum of 50% telecommuting, however, they are required to apply and obtain approval through management in accordance with The Department of State Telecommuting Program Guidelines.

Positions located within the New York City metropolitan area, as well as Suffolk, Nassau, Rockland, and Westchester Counties, are also eligible to receive an additional $4,000 annual downstate adjustment.
