How This Role Impacts Live Oak and its People

This role supports the in-house legal team’s formal responses to discovery and subpoena requests served upon the Bank.  This paralegal position serves as the central hub for organizing and producing documents in offensive and defensive litigation and third party subpoenas. 

  

What You’ll Do at Live Oak

The Lending and Operations Paralegal is responsible for reviewing, organizing, and responding to document requests pursuant to subpoenas and written discovery.  The Bank has experienced an increase in formal document requests, which will only increase as we grow our loan portfolio and deposit customer base.  While this person will report to the Managing Counsel, he/she will also work with other attorneys inside and outside the Bank as well as Risk and Compliance personnel.  The position will also “own” any software procured by the Bank to track, store, and share responsive documents.   

How You’ll Do It           

  • Responsible for procuring and uploading responsive documents on file at the Bank, including loan files, deposit account files, electronic mail, and other media. 

  • Review and analyze responsive documents for subpoenas and electronic discovery by taking the “first pass” review, prior to attorney review.

  • Work closely and effectively communicate with attorneys, Special Assets personnel, Risk and Compliance personnel, and Information Security personnel, as needed, to procure and produce all appropriate documentation to fulfill documentation requests. 

  • Assist with tracking litigation and drafting memos for reporting such matters to the Board of Directors and senior management. 

  • Manage e-discovery software and be responsible for associated vendor payments and relations.

  • Promote teamwork and effectively manage dates and deadlines for outstanding document requests. 

  • Take initial drafting responsibility for subpoena response letters, collections letters, and settlement agreements. 

  • Continue to train and learn by attending educational workshops, reviewing professional publications, and benchmarking state-of-the-art practices.

  

Required and Preferred Experience

  • Minimum of 1 year of paralegal experience is preferred

  • Minimum of 1 year of civil litigation experience is preferred

  • Experience with civil court filings, loan documentation, and deposit account documentation is preferred

  • High school graduate or GED required

  • Paralegal studies degree preferred

  • General knowledge of legal terms, rules and documents

  • Proficient in Microsoft Office (Word, Excel, Outlook, and Power Point)

  • Critical, strategic and analytical thinking skills

  • Highly proficient computer, internet and electronic researching skills

  • Very detail-oriented with strong organizational skills

  • Excellent written and oral communication skills

  • Self-motivated, confident, energetic and creative

  • Ability to multi-task and manage narrow timelines

  • Ability to cross-train

The base pay range for this position is $33.65 - $52.88 per hour. Compensation may also include annual bonuses and long-term incentives, subject to various metrics and company policy. A candidate’s salary is determined by several factors including travel, relevant work experience or skills and expertise.
