Responsibilities
- You will serve as the Chief Disciplinary Counsel for the Office of Disciplinary Counsel (ODC) and as a Senior Litigation Attorney for multiple boards in routine to complex hearings.
- You will conduct substantive legal research into various aspects of professional practices relating to disciplinary actions and will generate and respond to legal motions, orders, and settlement documents.
- You will prepare for, and conduct appeals and motion hearings for assigned boards before the Administrative Law Court, Court of Common Pleas, Court of Appeals and South Carolina Supreme Court.
- You will direct and manage the operations and services of ODC to include promoting teamwork, ensuring attorneys and staff are trained, leading recruitment and retention efforts, and assessing staff performance and needs.
- You will direct, oversee and monitor ODC’s case management, identify issues and trends impacting productivity and develop strategies and goals for effective case management results.
- You will provide senior level legal assistance with responding to FOIA requests, inquiries, and issues related to disciplinary matters as well as providing guidance and direction on procedural, evidentiary, and other legal matters related to investigations, inspections, and the disciplinary process and/or hearings.
- You will provide assistance to the General Counsel and work with strategic planning efforts and agency initiatives in support of LLR’s mission and directives.
- Minimum and Additional Requirements
Minimum Qualifications
- A juris doctor degree or its equivalent from an accredited law school and experience as a practicing attorney.
- Member of the SC Bar.
Preferred Qualifications
- Minimum of 10 years’ experience as a practicing attorney.
- Completion of Rule 403 requirements.
- Knowledge of SC laws, Administrative Procedures Act, policies, standards and procedures of the AG's office, general case, statutory and common law, judicial and quasi-judicial procedures and rules of guidance.
- Knowledge of Agency structure, mission, programs, and objectives.
- Ability to interpret laws, analyze facts, evidence and legal instruments, express conclusions and arguments clearly and logically, and make presentations and prepare reports.
- Ability to apply and explain laws and regulations of boards. Legal research and drafting of briefs, orders, and legal memoranda.
- Excellent verbal and written communication skills.
Other Requirements
- Position functions primarily in an office environment with extended periods of sitting and standing.
- Moderate work outside of normal Agency business hours.
- Occasional weekend work and travel (local and overnight).
- May be required to lift, carry, move and/or position objects weighing up to 25 lbs.
- Daily filing, data entry, telephone and computer use.
