Job Highlights

Provide education, outreach, consultation, and compliance enforcement to English and Spanish-speaking customers as an Industrial Relations Agent 2! In this role, you’ll focus on aspects of enforcement and administration of anti-retaliation provisions of the Minimum Wage Act. You’ll elevate awareness and understanding of Washington’s fair labor requirements, processes, and obligations from both employers and employees.

Duties

Some of what you’ll do:

  • Work independently to investigate and resolve Minimum Wage Act Retaliation complaints and Administrative Violations. With a substantial amount of discretional authority for exercising judgement, and in conjunction with above cited statutes and WAC rules, the employee in this position is expected to be fully knowledgeable, conversant and capable of applying and enforcing relevant administrative law and agency policies.
  • Identify and analyze issues in dispute, recommend solutions, and negotiate settlement or otherwise mediate and resolve disputes between employers and employees resulting from the alleged retaliation.
  • Collect documentary information and other substantiating evidence through interviews, observations, and examination of records. Obtain witness statements through telephone or in-person interviews.
  • Communicate with employers, employer representatives and employees via phone, email, and letters to resolve retaliation complaints as well as other Employment Standards disputes. Provide parties with copies of laws, rules, and administrative policies.
  • Determine validity of complaints by applying rules and regulations promulgated under the appropriate statutes e.g. whether a protected activity exists under RCW 49.46 and whether there was a materially adverse action against said employee.
  • Communicate with employers and employees in Spanish and English via phone, email, in person, and letters to resolve disputes.
  • Investigate other Employment Standards complaints. This includes, but is not limited to, WPA paid sick leave, and tips & service charges complaints.
  • Assist Retaliation Specialist with educational consultations for employers, workers, and others regarding retaliation rules and regulations, as well as other state labor and employment law in English and Spanish.

Qualifications

Required:

4 years of experience in labor/employment relations and regulations

OR

A relevant Bachelor's Degree and one year of experience in labor/employment relations and regulations

OR

A relevant Associate's Degree and two years of experience in labor/employment relations and regulations

AND

The ability to read, write, and speak fluently in Spanish and English.

AND

  • The ability to take action to learn and grow.
  • The ability to take action to meet the needs of others.

Desired:

  • Experience working with employees who have experienced retaliation, and/or investigating allegations of discrimination/retaliation.
  • Knowledge of laws governing all phases of labor relations, general policies, principles and practices of labor, and management state wage and hour laws and regulations; contracts and related labor relations; ability to apply such knowledge in mediation, arbitration, and resolution principles; standards and techniques of personnel investigations; rules of evidence; auditing; accounting and bookkeeping procedures.
  • Understanding of interaction between federal and state statutory schemes concerning employment standards.
  • Ability to interpret complex laws, rules and regulation; analyze issues involving wage disputes; prepare written documents; organize facts; arguments and conclusions in clear and logical sequence; gather, preserve and present material; relevant and pertinent evidence; exercise judgement in a wide variety of public contact.
  • Public sector experience in explaining laws and regulations.
  • Experience working with applications or systems such as Outlook, Excel, Word, CATS, LINIIS, and BEAR.
  • Ability to apply knowledge to mediation, arbitration, and resolution; the principles, standards and techniques of personal investigations, rules of evidence, auditing, accounting and bookkeeping procedures.
  • Ability to develop methods and techniques for solving employer wage and hour problems; establish and maintain productive working relationships; prioritize and manage work schedule; work independently.
  • Experience researching and gathering information
  • Experience working with limited English proficient communities and explaining RCWs and WACs.

For this position, telework is dependent upon business needs and supervisor approval. The duty station of this position is Tumwater, Washington, with options to telework anywhere in the state. A duty station is the location a position is assigned, permanent worksite. This position is not eligible to receive King County premium pay, as the duty station is not in King County.

For positions where in-office work is necessary, the frequency of telework will be discussed with the supervisor of the position at the time of offer.

Insurance Benefits
Employees and their families are covered by medical (including vision), dental and basic life insurance. There are multiple medical plans with affordable monthly premiums that offer coverage throughout the state.

Retirement and Deferred Compensation
State Employees are members of the Washington Public Employees' Retirement System (PERS). New employees have the option of two employer contributed retirement programs. For additional information, check out the Department of Retirement Systems' web site.

Employees also have the ability to participate in the Deferred Compensation Program (DCP). This is a supplemental retirement savings program (similar to an IRA) that allows you control over the amount of pre-tax salary dollars you defer as well as the flexibility to choose between multiple investment options.

Social Security
All state employees are covered by the federal Social Security and Medicare systems. The state and the employee pay an equal amount into the system.

Public Service Loan Forgiveness
If you are employed by a government or not-for-profit organization, and meet the qualifying criteria, you may be eligible to receive student loan forgiveness under the Public Service Loan Forgiveness Program.

Holidays
Full-time and part-time employees are entitled to paid holidays and one paid personal holiday per calendar year.

Note: Employees who are members of certain Unions may be entitled to additional personal leave day(s), please refer to position specific Collective Bargaining Agreements for more information.

Full-time employees who work full monthly schedules qualify for holiday compensation if they are employed before the holiday and are in pay status for at least 80 nonovertime hours during the month of the holiday; or for the entire work shift preceding the holiday.

Part-time employees who are in pay status during the month of the holiday qualify for the holiday on a pro-rata basis. Compensation for holidays (including personal holiday) will be proportionate to the number of hours in pay status in the month to that required for full-time employment, excluding all holiday hours. Pay status includes hours worked and time on paid leave.

Sick Leave
Full-time employees earn eight hours of sick leave per month. Overtime eligible employees who are in pay status for less than 80 hours per month, earn a monthly proportionate to the number of hours in pay status, in the month to that required for full-time employment. Overtime exempt employees who are in pay status for less than 80 hours per month do not earn a monthly accrual of sick leave.

Sick leave accruals for part-time employees will be proportionate to the number of hours in pay status, in the month to that required for full-time employment. Pay status includes hours worked, time on paid leave and paid holiday.

Vacation (Annual Leave)
Full-time employees accrue vacation leave at the rates specified in WAC 357-31-165(1) or the applicable collective bargaining agreement (CBA). Full-time employees who are in pay status for less than 80 nonovertime hours in a month do not earn a monthly accrual of vacation leave.

Part-time employees accrue vacation leave hours in accordance with WAC 357-31-165(1) or the applicable collective bargaining agreement (CBA) on a pro rata basis. Vacation leave accrual will be proportionate to the number of hours in pay status, in the month to that required for full-time employment.

Pay status includes hours worked, time on paid leave and paid holiday.

As provided in WAC 357-58-175, an employer may authorize a lump-sum accrual of vacation leave or accelerate the vacation leave accrual rate to support the recruitment and/or retention of a candidate or employee for a Washington Management Service position. Vacation leave accrual rates may only be accelerated using the rates established WAC 357-31-165.

Note: Most agencies follow the civil service rules covering leave and holidays for exempt employees even though there is no requirement for them to do so. However, agencies are required to adhere to the applicable RCWs pertaining holidays and leave.

Military Leave
Washington State supports members of the armed forces with 21 days paid military leave per year.

Bereavement Leave
Most employees whose family member or household member dies, or for loss of pregnancy, are entitled to five (5) days of paid bereavement leave. In addition, the employer may approve other available leave types for the purpose of bereavement leave.
