THE STARTING SALARY FOR THIS POSITION IS LIMITED TO $87.849 - $103,184. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.
The Attorney III represents the N.C. Department of Transportation in eminent domain litigation at all levels of complexity. The attorney has responsibility for all phrases of litigation in land acquisition proceedings, including investigation, trials in the superior courts, and appeals to the Court of Appeals and the Supreme Court. The attorney provides legal advice and representation to the Right of Way Branch with respect to questions of law involved in appraisal and valuation of properties.The primary duty of a trial attorney in this position is to represent the Department in the trial of eminent domain actions for the acquisition of real estate for highway purposes in cases where the Department’s Right of Way Branch has been unable to effect settlement with landowners, and legal proceedings have to be instituted.

The primary purpose of the North Carolina Department of Justice – Legal Services (DOJ) is to carry out those duties set forth in N.C.G.S.’ 114-2, i.e., to provide legal services to state government. The Attorney General's Western Office is constituted as a separate Section within the Civil Division of DOJ. The primary purpose of the Western Office is to provide legal representation for the State and state agencies in a variety of legal matters as assigned within the geographic coverage area of the office.

The office is primarily a litigation office with the major focus, in terms of caseload size and trial practice, being on representation of the North Carolina Department of Transportation (DOT). The attorneys assigned to the Western Office represent DOT in highway condemnation cases filed by DOT, inverse condemnation cases filed against DOT, and in miscellaneous litigation involving highway rights of way in which DOT is a party. The Western Office coverage area for this type of litigation is the twenty-seven westernmost counties of the state.The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the state, state agencies, and elected officials, and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally, the Department of Justice includes the North Carolina State Crime Lab, the North Carolina Justice Academy, and the Sheriffs’ and Criminal Justice Education and Training Standards Divisions.

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise - Supplemental and Contact Information
