The Office of the Utah Attorney General is seeking an experienced attorney to serve as the Office's Government Records Counsel. This is a senior level attorney position, and the best qualified candidate will have experience in state and federal courts as well as working knowledge of the Government Records Access and Management Act (GRAMA).
Incumbents must practice law as an active member of the Utah State Bar in good standing. This position requires excellent written and oral advocacy skills. The GRAMA Records Counsel is responsible for the management, oversight, and coordination of incoming GRAMA requests directed to the Office of the Utah Attorney General (OAG); and handling GRAMA appeals before the Chief Administrative Officer of the OAG, Government Records Office, and district courts. - Responsibilities
Primary duties include, but are not limited to:
- Manage assigned GRAMA staff
- Stay abreast of the law regarding access to and management of government records.
- In consultation with the GRAMA Committee and with the approval of OAG leadership, develop and maintain government records policies and procedures, and similar resources.
- Provide support to Division Directors and Division GRAMA representatives as they advise their client agencies regarding GRAMA matters.
- Serve as a liaison between the OAG and the State Records Ombudsman.
- Be knowledgeable regarding records retention schedules and serve as a resource to OAG in establishing and modifying retention schedules.
- Assist OAG with GRAMA-related legislation or other policy development.
- Assist the OAG to write rules respecting the proper handling of all GRAMA matters.
- Serve as a GRAMA training resource for the OAG and for other governmental agencies and entities as appropriate.
- Qualifications
Qualified applicants must comply with the requirements of Utah Code § 63A-12-202 including:
- Be an attorney in good standing and authorized to practice law in Utah by the Utah State Bar Association.
- Be knowledgeable in state and local law and practice in relation to records access and management, specifically in regards to the Government Records Access and Management Act (GRAMA).
- Have good legal writing and research experience.
- Have experience with state agencies and/or local governments.
- Have experience managing employees.
- Possess the ability to write and administer Administrative Rules.
- Have the ability to adjudicate appeals relating to the disclosure or nondisclosure of records in a manner that is impartial, responsible, and strictly in accordance with the requirements of law.
- Be able to mediate conflicts.
- Be able to provide ongoing performance metrics and a report annually as required by Utah Code § 63A-12-202(6)
- Supplemental Information
- A Juris Doctorate is required.
- Risks found in the typical office setting, which is adequately lighted, heated and ventilated, e.g., safe use of office equipment, avoiding trips and falls, observing fire regulations, etc.
- Typically, the employee may sit comfortably to perform the work; however, there may be some walking; standing; bending; carrying light items; driving an automobile, etc. Special physical demands are not required to perform the work.
- A conditional offer of employment will be made pending a satisfactory completion of a background investigation.
- Where statute mandates, active membership in the Utah State Bar.
- Must be able to travel as required.
- Valid driver license required to drive a motor vehicle on a highway in this state per UCA 53-3-202(1)(a).
- Salary is calculated based on initial Bar admittance year, less any years not practicing law, as outlined below.
