Assistant City Attorney – Prosecutor


JOB SUMMARY


The purpose of this position is to represent the City’s interest in municipal court and to serve as legal advisor to City staff with business involving the municipal court. 


ESSENTIAL JOB FUNCTIONS

  • Represent the City in the City of Myrtle Beach Municipal Court to include Quality of Life Court, Domestic Violence Court and Homeless Court. 


  • Represent the City in the negotiation and prosecution of violations of City ordinances and Class C misdemeanors.  


  • Represent City in jury trials, bench trials, motion hearings, roster meetings, bond hearings, appeals and other related matters.  Prosecutorial responsibilities include preparation of pleadings, discovery, motions, settlement agreements, and correspondence, both written and verbal, with opposing counsel, parties, victims, and court personnel. 


  • Perform other prosecutorial responsibilities as required or assigned.


  • Assist Myrtle Beach Police Department and other departments to develop and/or amend policies and procedures to maintain legal compliance and improve effectiveness in Municipal Court. Assure effective communication of legal issues between the City Attorney’s Office and City principals. 


  • Monitor legislative changes affecting criminal law and procedure.


  • Supervise assigned staff. Schedule, assign, instruct, guide and check work. Appraise employee performance. Provide for training and development. Enforce personnel rules and regulations, and work behavior standards firmly and impartially. Counsel, motivate and maintain harmony. Interview applicants for open staff positions. Recommend hiring, termination, transfers, discipline, merit pay or other employee status changes, as requested.


  • Support the relationship between the City and the public by demonstrating courteous and cooperative behavior when interacting with citizens, visitors and City staff; promote the City goals and priorities. Maintain absolute confidentiality of work-related issues and City information. Perform other legal duties as required or assigned.

  • Participate in team meetings, as needed or requested. 
  • Perform other related duties as required, requested and assigned.

Minimum Qualifications

Education and Experience:

This position requires excellent oral advocacy and written communication skills.  Candidate must possess a Juris Doctorate Degree and must be admitted to the South Carolina Bar or, in the case of a recent graduate, gain admission to the South Carolina Bar within three months of employment.  

Licenses or Certifications:

None.


Special Requirements: 

Must be (or become within three months of employment) a member of the South Carolina Bar Association and maintain good standing.

  • Ability to prepare pleadings, correspondence and other case-related documents meeting high professional standards.
  • Ability to compose responses, correspondence, emails, and other documents in a clear and professional manner.
  • Ability to establish and handle multiple projects and details simultaneously; finish work in allotted timeframes.
  • Ability to relate well to all kinds of people and build constructive relationships, both inside and outside of the organization.
  • Ability to utilize a variety of communication and interpersonal skills to interact successfully with people at a number of levels inside and/or outside of the organization.
  • Ability to remain calm under pressure. 
  • Ability to operate general office equipment to include scanner, printer, copier, fax, telephone, DVD/CD duplicator, external hard drive, and computer with Microsoft Office Suite.
  • Ability to utilize specialized software and systems to include Evidence.com. 
  • Ability to review, classify, categorize, prioritize, and/or analyze data. 
  • Ability to operate, maneuver and/or control the actions of equipment, machinery, tools, and/or materials used in performing essential functions. 
  • Ability to utilize a wide variety of reference, descriptive, and/or advisory data and information.
  • Ability to interpret instructions furnished in written, oral, diagrammatic, or schedule form.

PHYSICAL DEMANDS

The work is light work. The employee is frequently required to apply 10 pounds of force to move objects. The employee is occasionally required to exert up to 20 pounds of force to move objects. Additionally requires:  hearing voices, mental acuity, speaking, standing, expressing ideas by the spoken word, and visual acuity in data. Tasks may require the ability to: sit for extended periods of time at a keyboard or work station.

WORK ENVIRONMENT


Work is performed in an office, courtroom, or meeting room setting without exposure to adverse environmental conditions. Work is performed in a dynamic environment that requires sensitivity to change and responsiveness to changing goals, priorities, and needs.
