This position may be eligible for hybrid remote work in accordance with state policy and the agency’s remote work program but does require weekly onsite work.


Are you a skilled legal professional passionate about technology, procurement, and compliance? The North Carolina Department of Information Technology (NCDIT) is seeking a dynamic and knowledgeable Assistant Agency General Counsel II to join our Office of the General Counsel. 

This role offers an exciting opportunity to provide critical legal support on IT contracts, procurement processes, and compliance with state and federal regulations. As a key member of our team, you'll play a pivotal role in ensuring that IT agreements and vendor negotiations align with legal requirements, mitigating risks while advancing the strategic goals of NCDIT.

KEY RESPONSIBILITIES

Legal Research and Counsel: Conduct legal research and draft opinions, memoranda, and other documents on IT and procurement-related issues. Stay current with new precedents, statutes, and court decisions impacting the field.

Guidance and Support: Provide expert legal guidance to Statewide IT Procurement and NCDIT divisions on IT procurement strategies, contract negotiations, and legal compliance, especially concerning data security, privacy, and confidentiality.

Procurement and Public Records: Assist in responding to procurement-related public records requests and provide legal review to ensure compliance with transparency laws.

Collaborative Contract Development: Work closely with procurement and IT teams to craft contract terms that reflect department goals while minimizing legal risks.

Negotiations and Disputes: Draft, review, and negotiate complex IT contracts, including software licenses, cloud computing agreements, professional services contracts, and procurement documents. Assess legal risks and resolve any vendor performance issues or potential breaches.

Stakeholder Relations: Build and maintain effective working relationships with key stakeholders, including the Attorney General’s Office and other internal and external partners.

ABOUT THE DIVISION


The NCDIT Office of the General Counsel provides legal guidance and support to the North Carolina Department of Information Technology (NCDIT) by ensuring compliance with state and federal laws, managing legal risks, overseeing IT contracts and procurement processes, and advising on policies related to information technology, IT procurement, cybersecurity, and all related NCDIT programmatic areas.

To qualify for this position, applicants must document on the application that they possess ALL of the following:

  • Experience with drafting, reviewing, and/or negotiating contracts preferably including software licensing agreements, cloud computing contracts, professional services agreements, and procurement documents
  • Experience conducting legal research on new precedent and statutes
  • Experience providing effective legal guidance to multiple levels of stakeholders
Management Preferences
  • Experience with IT and/or procurement law, with a focus on state and federal regulations

Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience. 

NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

HYBRID/FLEXIBLE WORK SCHEDULES:

If you do not currently reside within a reasonable commuting distance of the assigned duty station, new hires are granted up to 120 days from their start date to relocate.
