Job Summary:
We are seeking an Associate Attorney to support the In-House Legal Department.
In this key role, you will assist the In-House Legal Department and deal directly with legal counsel, nationwide, who are representing equipment vendors and equipment lessees. Your responsibilities will include resolution of claims, researching legal questions and responding to inquiries by staff, responding to discovery, reviewing various pleadings for accuracy and consistency, reviewing and monitoring cases in litigation including dealer suits, and generally deal with internal corporate legal matters as needed.
Key Responsibilities:
- Work with opposing counsel to resolve disputes and assess whether litigation is necessary.
- Initiate, approve, and monitor settlements negotiation and payment arrangements on pre-litigation accounts.
- Communicate legal support and analysis including Article 2A of the Uniform Commercial Code and relevant case law to opposing counsel.
- Draft responses to Discovery, Interrogatories, Request for Admissions/Request to Produce on Plaintiff matters.
- Draft Company response to lessee dispute letters, effectively identifying relevant issues and asserting the Company’s best arguments. Advocate on behalf of Company to resolve disputes and litigate when necessary.
- Consult and advise on asset recovery where lessee is represented by counsel.
- Work closely with the Bankruptcy Clerk to determine Company’s position relative to Chapter 7, 11 and 13 Bankruptcy Filings.
- Assist In-House Legal staff in preparing and monitoring dealer suit filings in Massachusetts.
- Assist in area of Defense litigation as needed. This will include but will not be limited to, responding to Discovery/Interrogatories/Request for Admissions/Request to Produce, securing dealer responses to allegations, investigating claims, drafting and reviewing pleadings and affidavits, and legal research on specific issues.
- Conduct research and produce memoranda on legal issues and advisement on new industries and products.
Required Experience, Education, Skills and Competencies:
- Substantive litigation experience in either an in-house environment or law firm as either a Paralegal or Attorney. Law degree with membership to the MA bar is a plus.
- Must have solid communications skills for extensive oral and written communication with outside counsel.
- Ability to resolve complicated legal and financial issues both in-house and with outside counsel.
- Comfortable with adversarial communication and ability to articulate the Company’s positions in stressful situations while maintaining composure and professionalism.
- Must be an energetic self starter, well organized, detailed oriented, and be willing to take on additional levels of responsibility.
- Other duties assigned by your supervisor.
