This position is located in General Counsel, Richland County

Are you the one? We are looking for an Attorney III, who will provide legal opinions and advice to the Department, as well as representing the Department in matters in a variety of venues.

  • Provides legal advice to Department staff on legal issues that arise related to the Department's Office of Civil Rights & Privacy, including state and federal privacy and confidentiality statutes and regulations (including HIPAA and Medicaid safeguarding) and state and federal anti-discrimination statutes and regulations (including ADA and Section 1557 of ACA).  Provide legal advice to Department's Ethics Officer, as it related to matters under the Department's Code of Conduct and the SC Ethics Act.  
  • Provides legal advice to Department staff on matters related to Eligibility. Reviews Special Needs Trusts, providing legal interpretations. Represents the Department in appeals and other litigation related to Eligibility at the trial and appellate levels in both state and federal court.
  • Represents the Department in administrative hearings before the Division of Appeals and Hearings and other venues as necessary, with specific focus on Eligibility cases involving the Department.  Working within the structure and processes established by the General Counsel.  
  • Provides legal advice to Department staff on legal issues that arise related to the Department's procurements and contracts, including reviewing documents for legal issues and to ensure compliance with State/Federal statutes and regulations, including but not limited to, the South Carolina Consolidated Procurement Code and the Uniform Administrative Requirements for Health and Human Services Awards.  Responsible for the negotiation, legal sufficiency, and drafting of contractual documents in the specialized areas of the Medicaid program (Title XIX) and the BabyNet (IDEA Part C) program.  
  • Provides legal opinions to administrative and program staff in the interpretation of Department policies as they relate to state and federal laws and regulations and recommends appropriate actions

Minimum and Additional Requirements

A Juris Doctor Degree from an accredited law school and experience as a practicing Attorney.

Special Requirements: Member in good standing of the South Carolina Bar. Completed all Rule 403 requirements.

Must have and maintain a valid driver's license.

Additional Requirements:

  • Occasional overnight travel.
  • Sitting or standing for long periods of time.
  • Lifting requirements: 20 lbs.

Preferred Qualifications

  • Knowledge of the laws of South Carolina.  
  • Ability to communicate effectively.  
  • Ability to interpret and apply laws and judicial decisions.  
  • Should possess excellent research skills, be organized, and have some litigation experience.
  • A thorough knowledge of Medicaid laws and regulations and health care law. 
  • Utilizes discretion and sound judgment at all times. 
  • Must have proficient communication skills; both verbal and written. 
  • Ability to make and keep schedules. 
  • Basic computer and math skills. 
  • Ability to establish and maintain effective working relationships. Capable of using standard office equipment.
