Job Description Summary


This position works under the general direction of the General Counsel and is assigned five primary areas of responsibility: (1) Title IX coordination, (2) labor and employee relations and EEO matters, (3) public records, (4) policy development, and (5) contract review.

Title IX and EEO responsibilities include serving as the institution's designated Title IX Coordinator, overseeing the University's compliance with Title IX of the Education Amendments of 1972 and other discrimination laws; recruiting, training, and monitoring the work of part-time, volunteer Deputy Title IX Coordinators; overseeing the team of investigators, hearing officers and advisors for allegations of misconduct, specifically sexual misconduct, gender-based discrimination, harassment, intimate partner violence, and stalking, that are brought by students, faculty, and staff; providing or facilitating training, informational sessions, consultation and technical assistance on Title IX for students, faculty, and staff; remaining abreast of changes in the regulatory environment; recommending and drafting policy and procedure changes; responding to complaints with outside federal and state agencies on matters of alleged discrimination.

Labor and Employee Relations responsibilities include, with respect to the University's two non-faculty unions: Establishing and maintaining effective labor-management relations subject to management guidance and approval; representing the administration in collective bargaining by serving as a lead negotiator; providing assistance with interpretations of collective bargaining agreement (CBA) provisions as required; and assuring the effective administration of the various CBAs through ongoing educational guidance and support to those charged with direct supervision of operating units; providing assistance to the president and other University officials via an established process for the adoption of memoranda of understanding (MOUs); processing union grievances, including presentation of cases at arbitration as necessary; responding to allegations of unfair labor practices filed with outside state agencies.

Public records responsibilities include gaining and maintaining familiarity with Ohio's Public Records Act; receiving and acknowledging public records requests; working with records custodians to compile potentially responsive records; reviewing records for exemptions and material needing redaction in whole or part; producing responsive, non-exempt records to requester within a reasonable period of time; maintaining annual log of requests and responses; working with outside auditor on compliance issues; training staff on their responsibilities with respect to public records.

Policy development responsibilities involve working with General Counsel to monitor policies and procedures that require renewal, rescission, or revision; ensuring that policies and procedures are compatible with state and federal law, and with collective bargaining agreements; drafting and editing policies and procedures in preparation for final approval; maintaining and coordinating the renewal and scheduled reviews of policies, procedures, and administrative guidelines.
Contract duties include familiarizing self with required and prohibited provisions of contracts for state universities; reviewing and revising draft contracts for compliance with state and federal law, upon request from Director of Procurement; providing training as necessary.

DUTIES AND RESPONSIBILITIES
  1. Administer University’s Title IX compliance program.
  2. Facilitate prompt responses and provision of supportive measures to individuals who may have been subjected to sexual misconduct, including but not limited to those who file formal complaints.
  3. Oversee Title IX grievance process, including investigations and adjudications.
  4. Effectively implement Title IX remedies and supportive measures.
  5. Ensure proper training for investigators, decision-makers, advisors, and individuals who facilitate informal resolutions.
  6. Ensure compliance with University’s duty to provide notice of Title IX procedures and reporting structure, and maintenance of Title IX records, including training records.
  7. Serve as lead negotiator for the administration for collectively bargained agreements with support staff and public safety employees.
  8. Prepare, conduct, and supervise those selected to participate in the administration’s committee for bargaining sessions.
  9. Assure the effective administration of all collectively bargained agreements.
  10. Serve as administration’s liaison with union officials on matters pertaining to terms and conditions of employment.
  11. Develop memoranda of understanding as needed.
  12. Provide assistance to administrators/supervisors in the interpretation of provisions of the CBA and/or MOUs; provide assistance and advice regarding possible courses of action in resolving allegations of CBA violations.
  13. Develop, manage, and maintain thorough and accurate records for bargaining matters.
  14. Develop and manage positive employee relations programs. Ensure the University is maintaining an environment where supervisory interactions with employees are in line with collective bargaining agreements.
  15. As needed, manage the University’s union election strategy and responses to union organizing review.
  16. Lead the development and management of University policies. Ensure policies comport with the law and applicable provisions of collectively bargained agreements. Manage the required stakeholder involvement in the implementation of relevant Board policies.
  17. Ensure that University timely and properly responds to public records requests.
  18. Represents University in labor arbitration as warranted.
  19. Conduct regular training and educational opportunities to University populations on assigned areas of responsibility.

Minimum Job Knowledge, Skills and Abilities

  • Effective interpersonal and communication skills to communicate and negotiate with a variety of constituents and audiences regarding contractual matters and personnel decisions; ability to maintain effective working relationships with executive staff, labor leaders, attorneys, courts, and government representatives.
  • Strong evidence of ability to maintain organized records and to clearly and effectively document results of a myriad of interactions.
  • Strong analytical skills needed in order to develop appropriate policies and to ensure compliance to same in coordination with all levels of university personnel.

Minimum Qualifications

 
  1. Law degree and license to practice law in Ohio, or ability to obtain Ohio licensure within one year of hire.
  2. Satisfactory background check to qualify for cross-designation as Assistant Ohio Attorney General.
  3. Minimum 1-3 years of prior employment (as attorney or non-attorney) in position of responsibility conducting investigations, including witness interviews, collection and assessment of evidence, and report writing.

Preferred Qualifications:
  1. Experience in Title IX, equal employment opportunity, higher education law, and/or related fields.
  2. Experience in labor relations.
  3. Knowledge of federal rules and regulations in areas such as Title IX, equal employment opportunity, and disability accommodation.
  4. Experience in policy development, education, and communication.
  5. Expertise in an environment increasingly reliant upon technological innovations for record-keeping and workflow process administration.
  6. Comfortable working in a complex organization and interpreting multiple contracts, policies, and practices pertinent to the needs of various constituencies.

This position reports to the General Counsel.
Responsible for indirect supervision of personnel during labor negotiations.
