Job Description

POSITION SUMMARY

 The Assistant Corporation Counsel provides civil legal advice and representation on diverse issues for the Corporation of Eau Claire County, its County Board, agents, boards, committees, commissions, and departments.  

Positions will be reviewed as they come in.

QUALIFICATIONS

  • Provides general legal services for Eau Claire County, its County Board, agents, boards, committees, commissions, and departments regarding matters involving official business of Eau Claire County relying on expertise in municipal and public law applicable to County government. 

  • Studies, analyzes, interprets, and applies laws, court decisions, ordinances, state statutes, and other legal authorities in order to advise County officers, department heads and political subdivisions on legal matters; ensures affected parties are kept informed. 

  • Researches, drafts, formulates, and expertly presents, both orally and in writing, on various legal matters and opinions regarding county government such as summons, petitions, legal briefs, court orders, appellate briefs, resolutions, or ordinances for consideration by the County Board of Supervisors and its Committees. 

  • Reviews, researches and drafts contracts, leases, and purchase agreements; negotiates or assists in negotiating final documents. 

  • Prepares and conducts litigation concerning county legal matters, including presenting evidence and making oral argument before the court.  

  • Initiates leadership abilities to coordinate the efforts of corporation counsel staff and staff from other county departments to obtain relevant facts, data, documentation or other supportive information or evidence. 

  • Practices motivational interviewing techniques with affected parties. 

  • Determines the adequacy and accuracy of findings to ensure that cases are supported by adequate facts; applies relevant legal principles to cases; drafts documents to legal standards and specifications. 

  • Coordinates hearings before the Eau Claire County Circuit Court, Family Court Commissioner and Administrative Law Judges as necessary, staying cognizant of governmental organization and legislative procedures. 

  • Investigates, prepares, and prosecutes cases arising under the Eau Claire County Code of General Ordinances and Wisconsin Statutes Chapters 48, 51, 54, 55, 767, and 938. 

  • Maintains correspondence with County departments and various other agencies in matters pertaining to assigned work; reviews information for adequacy and accuracydirects procurement of further information as necessary. 

  • Acts as agent of the County in various transactions; performs duties related to real property transactions including legal work required in the tax deed process; provides legal representation for unemployment compensation cases and bankruptcy matters in which the County is a party. 

  • Performs the duties of Corporation Counsel in his/her absence. 

  • Performs other related duties as  or assigned. 

TRAINING AND PROFESSIONAL EXEPERIENCE QUALIFICATIONS

  • Graduation from an accredited law school.   
  • Appointment will be conditional upon successful completion of a criminal background check and a verification of license to practice law in the State of Wisconsin.  

  • Admission to the Wisconsin State Bar. 

  • Must possess and maintain licensure to practice law in the State of Wisconsin as a condition of employment. 

  • Must have valid driver’s license, an acceptable driving record, and access to private transportation for work-related duties  

  • Must possess and maintain personal automobile insurance in the amount of $100,000/$300,000. 


DESIRED TRAINING AND PROFESSIONAL EXERIENCE QUALIFICATIONS

  • Previous experience as an attorney in municipal law. 

  • Working knowledge of Chapters 19, 48, 49, 51, 54, 55, 59, 66, 111, 767, and 938 of the Wisconsin Statutes. 

  • Knowledge of the following federal statutes as they apply to County programs:  ADA, The Adoption and Safe Families Act (ASFA), the Indian Child Welfare Act (ICWA), Bankruptcy, FMLA, FLSA, HIPAA, 42 USC 1983.
