Job Description

THE STARTING SALARY FOR THIS POSITION IS LIMITED TO $87,849 to $100,668. Client funded. Salary determination is based upon the candidate's education and experience related to the position, as well as departmental budget and equity considerations.

Provision of legal services to DOT in litigation.

The primary responsibility of this attorney is to represent and advise the DOT in state, federal and administrative litigation, including complex cases involving Information Technology, contract, employment, and other miscellaneous areas of law and litigation as assigned. The position independently prepares for and conducts courtroom and administrative litigation, negotiates settlements of cases, prepares legal opinions on rules and operations of the DOT, and answers inquiries on legal issues from the DOT and the public.

The Attorney III may participate with other attorneys to provide support in the investigation of case facts, research of statutory and case law, and preparation of pleadings, motions, discovery, and briefs. Cases assigned to the Attorney III require development of a case strategy, research in preparation for litigation, and conducting civil and administrative litigation.

Representation of the State in criminal appeals.

The Attorney III prepares briefs for the State in criminal appeals to the North Carolina Court of Appeals and Supreme Court. Preparation of the brief requires knowledge of the North Carolina Rules of Appellate Procedure, reading and summarizing a trial transcript, reading the defendant’s brief and the authority cited, researching relevant other authority, and writing arguments on the questions raised. Some cases require preparation of petitions for further review by the Supreme Court or responses to such petitions, and, where the petition is granted, new briefs. Oral argument in the appellate courts may be ordered, necessitating additional preparation.

The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the State of North Carolina in court and provides legal advice and representation to most state government departments, agencies, officers, and commissions. The Department also represents the State in criminal appeals from state trial courts, and brings legal actions on behalf of the state and its citizens when the public interest is at stake.

The salary grade for this position is LG08. State employees are encouraged to apply for positions of interest even if the salary grade is the same as, or lower than, their current position. If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result.

Qualifications

Knowledge, Skills and Abilities / Competencies

Management Preferences:

  • Considerable knowledge of case, statutory, regulatory, common law, government contracting and administrative law and procedures.
  • Considerable knowledge of civil procedure and the rules of evidence are required.
  • The attorney must be able to conduct civil litigation in state, federal and appellate courts. This requires highly developed skill in analyzing facts and evidence, interpreting and applying statutes, regulations, and case law, developing creative case strategy and tactics, and expressing legal arguments and conclusions clearly, concisely, and convincingly both orally and in writing.
  • The attorney must have the ability to establish and maintain effective working relationships with DOT employees at all levels, the judiciary, lawyers, and co-workers.


Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience.

NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

Applicants seeking National Guard Preference must attach a NGB 23A (RPAS) if you are a current member of the NC National Guard in good standing. If you are a former member of the NC National Guard who served for at least 6 years and was discharged under honorable conditions, you must attach either a DD256 or NGB 22.
