Reporting to the Vice President of Gift Planning (“VP”), the Director of Charitable Estate & Gift Planning will assist the VP in supporting charitable estate and gift planning throughout the Bon Secours Mercy Health Foundation (“Foundation. The Director of Charitable Estate & Gift Planning works closely with foundation market presidents and gift officers to provide legal and technical knowledge that supports relationships across the ministry with current and prospective planned giving and high-capacity donors, professional advisors, attorneys, financial professionals, and other fiduciaries who advise and support donors with their estate and gift plans by educating them about planned giving opportunities and charitable giving options. The Director of Charitable Estate & Gift Planning is also responsible for drafting and reviewing legal and other documents assigned by the VP related to and memorializing these complex gifts, review and preparation of legal documents related to governmental grants, general Foundation contracts and assisting the VP with Foundation legal and governance matters that may arise.
Essential Job Functions
Support the implementation of strategies to attract planned and complex gifts to support the Bon Secours Mercy Health Ministry.
Serve as a resource for BSMH Foundation market presidents, gift officers, foundation staff, and external professional advisors, attorneys, financial planners and others to support donors in exploring charitable gift options and implementing charitable gift strategies in their financial and estate plans that accomplish their charitable goals and objectives by supporting the BSMH Ministry.
Provide internal and external education regarding charitable gift vehicles and planned giving strategies and opportunities by developing and maintaining current planned giving materials and providing educational opportunities in the BSMH markets for attorneys, financial advisors, trust officers, accountants and other professionals and to foundation staff.
Maintain a high level of expertise regarding current state and federal tax laws, lifetime and testamentary charitable giving methods, and all legal aspects associated with charitable giving.
Draft and review philanthropic agreements for the Foundation, including endowment, donation, charitable gift annuity, naming, and other similar agreements.
Assist with developing and maintaining uniform fundraising policies and procedures that comply with legal and regulatory requirements and minimize risk of liability to the BSMH Foundation.
Assist with the preparation and submission of requisite legal and related documentation necessary to claim and receive payment of deferred gifts to the Foundation.
Support the evaluation of gifts of real and personal property for appropriateness and potential risk of liability exposure.
Be part of and develop collaborative relationships with members of the BSMH Legal Network.
Manage a portfolio of BSMH Foundation gift planning and major gift prospects and meet annual performance metrics.
Assist with review and revision of agreements related to governmental and private grants.
Support Foundation corporate and board governance as assigned by the VP.
Support due diligence process and related documents for Foundation-related transactions, including mergers acquisitions.
Ability to draft documents of substantial complexity combined with a track record of working effectively and independently in a high volume, high accountability environment.
Fulfill other duties as assigned by the VP.

Licensing/Certification
Current license to practice law in a jurisdiction within the United States, preferably in a state in which the Foundation operates.
Education
JD or equivalent degree from an ABA approved law
Work Experience
Minimum of 5-7 years of experience working with clients in the areas of estate planning, trust and probate administration, tax, real estate, and general business issues
