Job Title:  Assistant General Counsel- Pharmaceuticals

Location: Boston, MA (Hybrid) or Remote

Position Overview

Reporting to the VP and Head of Legal, US, the Assistant General Counsel (“AGC”), US Prescription Business Unit will be located either in Galderma’s Boston office in a hybrid (3 days in office) environment, or remote with a requirement to travel ~2-5 times per year for meetings. The role will partner closely with key stakeholders within the global and US cross functional teams. The successful candidate will have a minimum of 7 years of legal experience as a healthcare attorney advising on US Market Access/Reimbursement, managed care and patient services in a law firm, payer or pharmaceutical manufacturer environment, with some level of in-house experience preferred. They will be collaborative, pragmatic and agile, thriving in a dynamic high-growth environment while helping to create processes that support good governance and compliance at the highest level of ethical leadership. They will have experience advising on drug pricing, market access and reimbursement of pharmaceutical products in the U.S.; drafting, and negotiating agreements with private and public payers, Specialty Pharmacies, and PBM’s; and providing strategic advice & counsel on legal and regulatory issues related to pharmaceutical commercialization including Anti-Kickback Statute, CMS guidelines and False Claims Act.

Key Responsibilities

  • Provide strategic and operational legal guidance to the US Prescription Business Unit for the company’s development, launch, and commercialization activities in the U.S. of prescription products.
  • Draft, negotiate and review commercial agreements, including PBM, GPO, Medicare/Medicaid, payer, formulary, specialty pharmacy, wholesaler, discount and rebate, distribution, vendor and supplier contracts related to reimbursed prescription products for the treatment of various dermatological skin conditions.
  • Act as legal representative on US-based cross-functional Pricing Review Committee.
  • In collaboration with US & Global Legal & Compliance colleagues, develop and deliver compliance and risk management training, policies and strategies and provide day-to-day advice and counsel to organization on these matters.
  • Proactively provide timely advice, counsel and guidance to internal business stakeholders on various laws, rules, regulations and Galderma policies and procedures.
  • Collaborate and communicate with colleagues, business management and outside counsel on issues critical to the company’s success.
  • Research legal issues that could impact Galderma’s business.
  • Other duties as assigned.

Qualifications

  • Juris Doctor (J.D.) degree from an accredited U.S. law school required.
  • Active U.S. State Bar license and member in good standing required.
  • At least 7 years of legal experience as a healthcare attorney advising on US Market Access and patient services in a law firm, payer or pharmaceutical manufacturer with some level of in-house experience preferred
  • Proven track record in legal market access and reimbursement of pharmaceutical products in the U.S. including drafting, and negotiating agreements with private and public payers and PBM’s required.
  • Significant legal experience in Anti-Kickback Statute, CMS guidelines and False Claims Act required.
