EDUCATION, CERTIFICATION, AND/OR LICENSURE:
1. Bachelor’s Degree OR high school diploma or equivalent AND four (4) years of high-level administrative experience in a law firm or healthcare organization.
PREFERRED QUALIFICATIONS:
EDUCATION, CERTIFICATION, AND/OR LICENSURE:
1. Paralegal certificate from an accredited organization.
EXPERIENCE:
1. Three (3) years’ experience related to drafting, reviewing and negotiating contracts, leases, employee agreements, memoranda of understanding, non-disclosure agreements, intellectual property instruments, and other forms of commercial contracting instruments.
2. Three (3) years’ experience with healthcare related laws and regulations such as Stark, fraud and abuse, HIPAA, and similar laws.
3. Three (3) years’ experience related to preparing for depositions, hearings, trials, and conferences, including investigating factual evidence of a case and interviewing witnesses.
Three (3) years’ Experience in a private law firm, governmental agency legal department, or in house legal department.
CORE DUTIES AND RESPONSIBILITIES: The statements described here are intended to describe the general nature of work being performed by people assigned to this position. They are not intended to be constructed as an all-inclusive list of all responsibilities and duties. Other duties may be assigned.
1. Review contract terms and conditions making sure that they comply with federal and state laws and company policies.
2. Assist company personnel in interpreting contract terms and conditions that might apply.
3. Monitor governmental websites for excluded parties on governmental and OIG websites.
4. Provide training on contract requirements to various personnel.
5. Responsible, as assigned, for drafting, analyzing, amending, and negotiating contracts, under Attorney supervision.
6. Show proficiency with legal terminology, contract language, copyright principles, and computer systems.
7. Effectively use various relevant Internet resources.
8. Review contracts for key elements in accordance with policy and law and communicate to staff the meaning thereof.
9. Prepare, review, and, when directed, negotiate and amend, contracts on behalf while protecting company interests.
10. Assist in populating and maintaining the Legal Services Department’s contracts management system for the Central Region Facilities.
11. Support the Legal Services Department in all matters. Provide support to Attorneys and staff within the Department as needed.
12. Manage archiving and close out of completed files, including ensuring that files are complete and entry into contracts management system.
13. Perform sanctions screenings of all vendors and other due diligence and make record thereof.
14. Utilize analytical ability to assist Attorneys in all litigation matters, ensuring compliance with company policies and procedures, along with any government rules and regulations.
15. Organize and track production of evidence.
16. Perform basic legal research.
17. Maintain Attorneys’ calendars for deadlines, hearings, mediations, and trials.
18. Provide assistance on complaints against providers’ licenses as requested by Attorneys.
19. Assist staff with subpoenas.
20. Assist with internal investigations as requested by Attorneys.
21. Participate in continuing education activities to develop and maintain professional expertise.
22. Assist in training other personnel as directed.
23. Provide adequate notice to the Vice President & General Counsel prior to absence or lateness in accordance with departmental policy.
24. Maintain proper attendance, in accordance with company policy.
25. Work weekends and evenings on occasion as may reasonably be required in order to fulfill obligations and meet deadlines.
26. Report to work on time in accordance with hospital policy.
27. Promote and contribute positively to the teamwork of the department by volunteering to assist co-workers, contributing ideas and problem-solving with co-workers as observed by Attorneys.
28. Participate in planning and implementing change and maintaining and improving productivity through attendance and participation in staff meetings and discussions with Attorneys.
SKILLS AND ABILITIES:
1. Good grammatical skills.
2. Ability to proofread and edit documents.
3. Proficiency in reading and writing legal documents
4. Good verbal and written communication skills.
5. Good organizational skills.
6. Ability to analyze contracting documents and assess their compliance with internal policies and state and federal laws and regulations.
7. Experience with Microsoft Office suite and ability to use various computer programs.
