The District Attorney is seeking an experienced attorney to coordinate and evaluate in-house People’s appeal and Article 78 requests and simultaneously handle post-conviction litigation, including direct appeals, Article 440 motions, and federal writs of habeas corpus.


JOB RESPONSIBILITIES:

Specific duties will include, but are not limited to, the following:

Evaluate People’s appeal and Article 78 requests made through Office internal request system

Make recommendations to Appeals Bureau Chief on viability of such appeals and communicate with other bureaus about requests

Draft People’s appeals and Article 78 briefs under supervision of Appeals Bureau Chief and other bureau managers

Assign and edit People’s appeals briefs and Article 78s

Maintain statistics and prepare reports on People’s appeals and Article 78s

Create People’s appeals and Article 78s manual

Perform other duties of senior Appeals Bureau ADA, including:

Represent the People of the State of New York in post-conviction litigation in state and federal courts

Clearly and persuasively address complex legal issues orally and in writing

Maintain a substantial post-conviction caseload


QUALIFICATIONS:

Juris Doctorate degree, 5+ years of appellate prosecution experience, and 3+ years of People’s appeals experience

US Citizenship and New York State Residency as of the first day of employment

Superb writing, research, and analytical skills

Excellent organizational and communication skills

Excellent judgment and problem-solving skills

Strong work ethic and ability to meet and monitor deadlines

Passion for appellate litigation
