Summary

Handles all aspects of evidence.  Licensed certified Peace Officer through Texas Commission on Law Enforcement (TCOLE).   Serves subpoenas when needed.

Essential Duties and Responsibilities

To perform this job successfully, an individual must be able to perform each essential duty satisfactorily. If you are unsure if an item is your responsibility, clear it through the Chief Felony Prosecutor. All instructions must be cleared through the Chief Felony Prosecutor. 


PRIMARY DUTIES: 

Subpoenas:
  • Prepare, file, and track felony subpoenas, including Grand Jury subpoenas.
  • Double-check felony subpoenas for service at least one week before trial.
  • Enter the subpoena list in the Prosecutor System.
  • Keep Prosecutors informed of problems in serving witnesses.
  • Serve subpoenas as requested.

Witnesses:
  • Take statements from witnesses when requested by the Prosecutor. 
  • Locate witnesses when necessary. 
  • Schedule meetings for the Prosecutor with witnesses. 
  • Contact witnesses and arrange a time to appear in court.
  • During the trial, be available for calls from the witnesses.
  • Make travel arrangements for witnesses.
  • Pick up witnesses at the airport and transport them to the hotel and back to the airport.
  • Provide felony secretaries with a list of the times when witnesses will need to appear in court.
  • Contact and notify witnesses whose cases have been reset.
 Court:
  • Prepare court exhibits as instructed by the Prosecutor.
  • Prepare the courtroom as instructed by the Prosecutor.
  • Be available for instructions from the Prosecutor during lunch and after-hours during trial.

Case Preparation:
  • Check files for necessary, judgments, prints, rap sheets, bank records, and medical records and obtain any of these items that are missing.
Evidence:
  • Request evidence and videos from the arresting agency for review by the Prosecutor before trial and for use during the trial.
  • Make sure that the chain of custody for all items of evidence is carefully maintained without any gaps.

Attendance is an essential function of the job.

SECONDARY DUTIES:

It is required that this position be cross-trained with the Evidence Locker/Misdemeanor Investigator to be prepared to handle his/her duties when necessary.

Mandatory Qualifications

EDUCATION and/or EXPERIENCE

A High School Diploma or GED equivalent is required. Computer Skills are required.  Must be able to use Microsoft Word and Microsoft Outlook and be capable of learning other systems such as CCM, Prosecutor, and Odyssey. Must have a clean criminal record and be able to pass a criminal background check.

CERTIFICATES, LICENSES, REGISTRATIONS

Must have a valid Texas Driver's License.  Must provide three (3) year driving record to operate County vehicles. TCOLE certification is required.

LANGUAGE SKILLS
Must be able to read and interpret documents such as judgments, witness statements, and offense reports.  Must be able to write routine reports and correspondence. Must be able to speak and communicate effectively with law enforcement officers, witnesses, and prosecutors. 

MATHEMATICAL SKILLS
Must be able to add, subtract, multiply, and divide in all units of measure, using whole numbers, common fractions, and decimals.  Must be to compute rate, ratio, and percentage and to draw and interpret bar graphs.

REASONING ABILITY
Must be able to apply common sense to carry out instructions provided in written, oral, or diagram form.  Must be able to deal with multiple problems with limited supervision during high-stress situations when the Prosecutor is in trial.
