About the Role:
The Review Examiner II performs duties of a hearing officer in connection with administrative hearings, conducted in accordance with M.G.L. c. 30A, primarily involving complaints against home improvement contractors registered pursuant to M.G.L. c. 142A, including drafting and issuing written decisions.
Duties and Responsibilities: (these duties are a general summary and not all inclusive):
The Hearing Officer will be responsible for conducting adjudicatory hearings, and issuing written decisions citing, where appropriate, statutes, regulations and case law in support of such decisions, in connection with complaints against home improvement contractors registered pursuant to M.G.L. c. 142A. Such duties include, but are not limited to, performing legal research and analysis with respect to disputed issues of fact and law. In connection with such adjudicatory hearings, the hearing officer's duties will include questioning witnesses, determining the admissibility of testimony and documents, interpreting applicable laws and regulations, and drafting and issuing written decisions, including findings of fact and conclusions of law.
The Review Examiner II will also provide additional support to the Senior Management Team regarding home improvement contractor, or other matters, as and when needed, as determined by the General Counsel.
Preferred Knowledge, Skills, and Abilities:
- A minimum of 4 years' experience as an arbitrator or hearing officer hearing complaints/disputes, involving legal interpretation and analysis, and fact finding; or must have been a trial attorney for a minimum of 4 years.
- Thorough knowledge of M.G.L. c. 30A requirements for adjudicatory hearings, and have a proven ability to write clear and concise decisions that conform to those requirements.
- Ability to analyze complex issues of law and fact and render fair and unbiased decisions based on the facts developed at such hearings.
- Proficient computer skills and excellent written and oral communication skills are essential.
- The ideal candidate for this position would be an attorney licensed to practice in Massachusetts, and in good standing, with 4+ years of experience trying civil cases involving allegations of breach of construction contracts.

SALARY PLACEMENT IS DETERMINED BY YEARS OF EXPERIENCE AND EDUCATION DIRECTLY RELATED TO THE POSITION AND THE HUMAN RESOURCES DIVISION’S RECRUITING GUIDELINES. IN THE CASE OF A PROMOTIONAL OPPORTUNITY, THE SALARY PROVISIONS OF THE APPLICABLE COLLECTIVE BARGAINING AGREEMENT WILL APPLY TO (OR WILL BE UTILIZED FOR) PLACEMENT WITHIN THE SALARY RANGE.

Minimum Entrance Requirements:
Applicants must have at least (A) four years of full-time, or equivalent part-time, professional experience, the major duties of which included the adjudication, examination and/or review of claims, benefits and/or taxes; the practice of law; labor relations work; claims investigation or adjustment work; credit management or credit investigation work; or (B) any equivalent combination of the required experience and the substitutions below.
Substitutions\:
I. A Bachelor's or higher degree with a major in law may be substituted for a maximum of three years of the required experience.*
II. A Bachelor's or higher degree with a major other than in law may be substituted for a maximum of two years of the required experience.*
*Education toward such a degree will be prorated on the basis of the proportion of the requirements actually completed.
NOTE\: Educational substitutions will only be permitted for a maximum of three years of the required experience.
