Job Description

The NC Department of Justice (DOJ) is looking for a leader, strategist, and partner to help us provide excellent representation to the clients represented by the Education Section. This position will be responsible for setting the tone and providing leadership and management for the Section.

The primary purpose of this position is to serve as the Section Head for the Education Section. To supervise, manage, and direct the Section as it provides legal services and advice to the Board of Governors of the University of North Carolina, the sixteen constituent institutions of the University of North Carolina, the North Carolina Education Assistance Authority, the North Carolina School of Science and Mathematics, the State Board of Community Colleges and the Department of Community Colleges, and the State Board of Education and the Department of Public Instruction.

The attorney in this position also litigates education cases and other matters for the Department, either solely or jointly, as lead-counsel or as non-lead counsel, with other attorneys in the Section. In supervising the Section, this attorney manager provides feedback on an ongoing basis, during one-on-one or group monthly meetings and through the State’s performance review program.This attorney handles a variety of administrative responsibilities, including the following: approving time in Beacon; monthly updating the DOJ Tracker; providing monthly highlights of work completed in the Section; compiling information for the DOJ annual report; compiling information for legislative reports submitted by DOJ; reviewing and approving travel expenses and other costs and expenses; and, updating job descriptions.

As a member of the management team, this position will be responsible for supporting the client and successfully balancing the needs of the NC DOJ and its initiatives.

The attorney in this position must exercise substantial discretion and make quick, independent decisions when appropriate, but also recognize when matters need to involve the Civil Division Head and others within DOJ. Additionally, the attorney in this position must be able to work effectively with individuals outside of DOJ, including high-level State officials in a complex, constantly changing environment.

This position is an excellent opportunity for an experienced civil litigator with management skills who has ability to promptly make management and legal strategy decisions and execute on those decisions.

THE STARTING SALARY FOR THIS POSITION IS LIMITED TO $116,147 - $141,535. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

The salary grade for this position is LG10. State employees are encouraged to apply for positions of interest even if the salary grade is the same as, or lower than, their current position. If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result.

Department Information:

The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the state, state agencies, and elected officials, and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally, the Department of Justice includes the North Carolina State Crime Lab, the North Carolina Justice Academy, and the Sheriffs’ and Criminal Justice Education and Training Standards Divisions.

This position is responsible for criminal appellate cases filed in the North Carolina Court of Appeals and/or the Supreme Court. In addition, the attorney will oversee and support the preparation of briefs handled by other attorneys within the Section, ensuring all deadlines are meet, consistency, quality, and compliance with procedural standards.

Qualifications

Knowledge, Skills and Abilities / Competencies

Management Preferences:

  • Demonstrated strong interpersonal skills.

  • Demonstrated ability to master technical areas of law.
  • Experience independently litigating cases in a variety of forums, including administrative tribunals and State and Federal courts.


Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and five years of progressively responsible professional legal experience.
NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

Applicants seeking Veteran's Preference must attach a copy of their DD-214 or discharge orders.

Applicants seeking National Guard Preference must attach a NGB 23A (RPAS) if you are a current member of the NC National Guard in good standing. If you are a former member of the NC National Guard who served for at least 6 years and was discharged under honorable conditions, you must attach either a DD256 or NGB 22.
